Transport and Technical Services (Driver and Vehicle Standards - 2015 Fees) (Jersey) Order 2014

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Transport and Technical Services (Driver and Vehicle Standards – 2015 Fees) (Jersey) Order 2014 which will increase fees for services provided at DVS and the fee for Compulsory Basic Training, from 01 January 2015.

 

Reason(s) for Decision:  To make the Transport and Technical Services (Driver and Vehicle Standards – 2015 Fees) (Jersey) Order 2014 and enable DVS to increase its fees in 2015 in line with the increased income assumptions in the Medium Term Financial Plan 2013-2015.

 

Resource Implications:  The additional income will assist in meeting the cash limits for DVS set for 2015.

 

Action required: To notify the Publications Editor and the Law Draftsman that the Order has been made, forward the signed and sealed Order to the Publications Editor, States Greffe, and request the Greffier of the States to arrange for its notification to the States.

Head of DVS to request the Department to revise the fees displayed on the States website and introduce the charges accordingly.

Head of DVS to confirm to Jersey School of Motorcycling the new CBT fee to be charged from 01 January 2015.

Purpose of the Report

 

To make the Transport and Technical Services (Driver and Vehicle Standards – 2015 Fees) (Jersey) Order 2014, which will increase fees for services, in January 2015. 

 

 

Background

 

On the basis of Ministerial Decision MD-T-2014-0116, it was decided to increase fees for services provided by the Department by approximately 2.5 percent, in order to meet the income obligation set out in the Medium Term Plan 2013-2015.  The fees charged for services provided by Driver and Vehicle Standards are prescribed and require the Minister to make an Order to set the new fees.  Similarly, the fee charged by Jersey School of Motorcycling (JSM) for providing Compulsory Basic Training (CBT) is prescribed.  The agreement with JSM is that the fee for CBT will increase on 01 January, by RPI at the previous September.  RPI in September 2014 was 1.8 percent.

 

 

Discussion

 

The Law Draftsman was asked to prepare the necessary changes to the Order on the basis of a brief provided by the Department.

 

The Transport and Technical Services (Driver and Vehicle Standards – 2015 Fees) (Jersey) Order 2014 is attached for the Minister to make the Order.  Making the Order will implement the increases in charges and will come in to force on 01 January 2015.

 

 

Recommendation

 

The Minister is recommended to make the Transport and Technical Services (Driver and Vehicle Standards – 2015 Fees) (Jersey) Order 2014 and request the Department to take the necessary action to implement the Order.
