Southern Bay Rose - passenger certificate

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:

Issue of passenger certificate for the vessel “Southern Bay Rose”.

 

Decision(s):

The Minister approved the issue of a Passenger Certificate & Licence (as attached) with conditions imposed in pursuance of the Shipping (Survey and Certification) (No2) (Jersey) Order 2005 and Part V of the Boats and Surf Riding (Control) (Jersey) Regulations 1969.

 

Reason(s) for Decision:

The passenger vessel Southern Bay Rose successfully completed its annual survey by the UK MCA on 12th March 2008 and requires the issue of a certificate and licence, as mentioned above, prior to commencement of its 2008 service.

Action required:

Up on receipt of ministerial agreement and a signed certificate, issue that certificate to the operator of the vessel for posting on the vessel.

PASSENGER CERTIFICATE & LICENCE

 

Shipping (Jersey) Law 2002, as amended

 

Boats and Surf Riding (Control) (Jersey) Regulations 1969 as amended

 

The Minister for Economic Development –

 

                (a)    in pursuance of the Shipping (Survey and Certification) (No2) (Jersey) Order 2005 being satisfied that the provisions of the said Order have been complied with in respect of the passenger vessel

 

SOUTHERN BAY ROSE

 

                 Hereby grants a Passenger ship Certificate in respect of the said vessel; and

 

         (b)    in pursuance of Part V of the Boats and Surf Riding (Control) (Jersey)                                    Regulations 1969, as amended, hereby grants to –

Albert Pier, St Helier, JE2 3NE

 

                 being the owner of the said vessel a Licence for the purpose of the said Part IV.

 

This Certificate and Licence shall be valid only from 20th March 2008 and provided the following conditions are observed.

 

         (a)     Operating hours to be between one hour before sunrise and one hour after sunset, in fine settled weather and reasonable sea conditions;

 

         (b)    Vessels operating area to be limited to within the limits such that the vessel will at no time be more than 1.85km (1NM) from the shore and no more than 18.5km (10NM) from the point of departure;

 

         (c)     That the maximum number of persons carried does not exceed –

                 (i)      one hundred (100) passengers; and

                 (ii)     two (2) persons forming the crew;

 

         (d)     Where an “Emergency Instructions” public announcement on abandon ship procedure is                         made before each voyage;

 

         (e)              Where a record of the number of persons on board is recorded ashore, before the commencement of each voyage; and the passenger/crew figure reported to Port Control on VHF channel 14 prior to departure from Port

 

         (f)      Where the requirements of the “Owner’s Declaration” are followed.

 

This Certificate shall remain in force until 31st October 2008.
