Immigration (Control of Entry through Republic of Ireland) (Jersey) Order 2018

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DECISION AND REASON FOR THE DECISION:

The Minister for Home Affairs made the Immigration (Control of Entry through Republic of Ireland) (Jersey) Order 2018.

 

The Order is made in pursuance of section 9 of the Immigration Act 1971 (“the 1971 Act”) as extended to Jersey with modifications made by the Immigration (Jersey) Order 1993 and the Immigration (Jersey) (Amendment) Order 2017.

 

There is a power by Order, in the United Kingdom and in Jersey, to impose certain restrictions and conditions on non-British citizens otherwise travelling lawfully within the Common Travel Area. The power to impose restrictions and conditions vests in the Secretary of State in the United Kingdom; but the corresponding power in Jersey vested partly in the Minister for Home Affairs and partly in the Lieutenant-Governor until the 2017 Order in Council came into force. Since then the corresponding power in Jersey has vested fully in the Minister in the same way as it vests fully in the Secretary of State in the United Kingdom.

 

The purpose of this Order is to repeal the Immigration (Control of Entry Through Republic of Ireland) (Jersey) Order 2015 which was made jointly by the Lieutenant-Governor and the Minister for Home Affairs before the 2017 Order in Council came into force, and to re-enact equivalent provisions in the name solely of the Minister for Home Affairs, in accordance with the 2017 Order in Council.

 

RESOURCE IMPLICATIONS:

None as a consequence of this decision

 

ACTION REQUIRED:

The Minister to sign and seal the Order and the Policy Officer to return the document to the States Greffe immediately. The Greffier of the States to be requested to arrange for the States Assembly to be notified at the earliest opportunity that the Order has been made.
