Licensing (Prescribed Forms) (Jersey) Order 1974: Proposed Revision of Application Form: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Assistant Minister approved the proposed new licencing application form and instructed officers to forward to Legislative Drafting the form and covering drafting instructions for a revised draft Order as soon as practicable.

Reason(s) for Decision:

In order to improve the customer experience, better manage the administration within existing resource constraints and improve data collection, The department would like to make incremental refinements to the existing application form and introduce an online process.

Resource Implications:

There are no negative financial or manpower costs for the States.

Licensing (Jersey) Law 1974 – Proposed Revision of Application and Renewal Forms

 

 

The Minister retains administrative responsibility for the Licensing (Jersey) Law 1974.

 

Day to day administration of licence applications and licence renewals is carried out in accordance with Articles 3 and 10 of the Law. Technically, Article 3 requires the use of an application form approved by the Licensing Assembly, while a renewal requires the use of a form prescribed by the Minister by way of an Order.  In practice, both are processed using the same hard copy application form as specified in the Licensing (Prescribed Forms) (Jersey) Order 1974, which is attached at Appendix A.

 

Until relatively recently, applications and renewals were managed by the States Treasury. During the latter part of 2018, however, operational responsibility for this activity was passed to the new Customer and Local Services Department as part of the ongoing transition to the Government of Jersey target operating model.  A subsequent appraisal of this transfer led to the conclusion that the activity would be more suitably managed within the Regulation section of what is currently the Growth, Housing and Environment Department.

 

In order to improve the customer experience, better manage the administration within existing resource constraints and improve data collection, GHE Regulation would like to make incremental refinements to the existing application form and introduce an online process. The proposed new paper application form would take a similar form to the attached design at Appendix B. The equivalent online form would be formatted differently but would request the same information.  

 

The Licensing Assembly has been consulted regarding, and has endorsed the design of, the draft form at Appendix B.

 

Recommendation

The Minister is invited to endorse the proposed new licensing application form and instruct officials to forward to the Law Draftsman the form and covering drafting instructions for a revised draft Order as soon as practicable.
