Road Traffic (Grouville) (Jersey) Order 2002: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister approved the request to amend the Road Traffic (Grouville) (Jersey) Order 2002.

 

Reason(s) for Decision:

To introduce restrictions on road side parking on Mont de Gouray, plus: -

 

1)      Prohibit waiting on part of La Grande Route des Sablons at La Rocque.

2)      Change traffic flow and parking around Grouville School.

3)      Prohibit waiting on Rue du Grouville in the vicinity of “4 hire”.

4)      Allow vehicles over 6’ 6” to drive through the existing width restriction by permission in writing of the Connétable.

5)      Introduce minor changes in Gorey Village.

ROAD TRAFFIC (GROUVILLE) (JERSEY) ORDER 2002

 

 

Purpose of the Report

 

To amend the Road Traffic (Grouville) (Jersey) Order 2002

 

 

Background

 

The Connétables of St. Martin and Grouville have requested that a restriction on the duration of road side parking be introduced on Mont de Gouray, between Chevre Rue and Le Mont Gabard, to enable the ticketing and subsequent removal of vehicles that have been parked for extended periods.

 

The Connétable of Grouville has also requested that: -

 

1)      prohibition of waiting be introduced on the coast road at La Rocque,

2)      Change to traffic flow and parking be introduced around Grouville school.

3)      Prohibition of waiting be introduced on Rue du Grouville in the vicinity of “4 hire”.

4)      Vehicles over 6’ 6” in width be allowed to drive through the existing width restriction by permission in writing of the Connétable.

5)      Minor changes be introduced in Gorey Village.  

 

Discussion

 

The boundary between St. Martin and Grouville crosses Mont de Gouray.  Therefore the two Parishes intend to work together to apply the same waiting restriction along the full length of the road, which is a DfI main road. They have agreed to request a seven day maximum stay with a minimum no-return period of one day. A consultation exercise was carried out by placing notices on the road describing the intentions of the two parishes. Eight responses were received – five in favour of a restriction on waiting approximately in line with the proposal and three against. Road side waiting is to be prohibited in all other sections of the road because the road is too narrow to accommodate parking on both sides at the same time. Plan 1.

 

  1. Road side parking on La Grande Route des Sablons at La Rocque in the summer can lead to danger for passing traffic. The Parish Police therefore wish to prohibit waiting in the area shown in Plan 2.

 

  1. In the vicinity of Grouville School - waiting to be prohibited on part of La Rue de la Ville es Renauds and along part of La Rue de la Haye du Puits. The right turn from La Rue de la Haye du Puits to La Rue Maraval is to be prohibited from 8am to 9am and from 2.30pm to 3.30pm, Monday to Friday only. These restrictions are already in place via a temporary notice under the Road Traffic Law. The right turn prohibition applies at all times under the notice but the Parish wishes to reduce this to a part time prohibition.

 

  1. Road side parking occasionally obstructs the free passage of traffic along Rue du Grouville on occasions when the company runs training courses and similar events. Following consultation with “4 hire” the Connétable requests that waiting be prohibited in the sections shown on Plan 3.

 

  1. The Connétable wishes to have the authority, under the provisions of the Traffic Order, to give permission for a named vehicle over 6’ 6” in width to drive along roads that the vehicle is otherwise excluded from by the Order.

 

  1. “Le Chemin Public” in Gorey Village has been re-named as “Limpet Lane” by the Parish. The road name should therefore be changed in the Order. Two road side parking spaces can be established, by removal of parking prohibition, outside the former Methodist Church in Gorey Village Road because the church has become a private residence.

 

 

Recommendation

 

The Minister is recommended to approve the proposed amendments to the Traffic Order.
