Compulsory purchase of leasehold land from Axa Sun Life PLC: Third Notice

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Compulsory Purchase of leasehold land from Axa Sun Life PLC. To enable the States through WEB to consolidate their control of land on the Waterfront and enter into a lease in relation to Esplanade Quarter.  

 

Decision(s):   The Minister decided to request the Greffier of the States to serve the Third Notice in relation to the compulsory purchase to notify AXA Sun Life PLC that an application for a vesting order was to be made to the Court  

 

Reason(s) for Decision: The freehold is owned by the Public of the Island and it is leased, together with other land, to AXA Sun Life Plc on a long lease.  In order to assemble the site for the Esplanade Quarter development, the leasehold interest needs to be acquired from AXA.  AXA was asked a number of times to enter into negotiations for the sale of this leasehold interest however no response was ever received and it has therefore been necessary to commence compulsory purchase proceedings. This is the third notice to be served on AXA as required by the Compulsory Purchase of Land (Procedure) (Jersey) Law 1961.  

The Minister agreed to commence compulsory purchase proceedings through ministerial decision MD-PE-2007-243 and the first and second notices have been served on the basis of that decision. No response has been received from AXA in relation to either of the previous notices. The States approved the Masterplan for Esplanade Quarter and the Compulsory purchase of AXA’s interest on 21st October 2008 (P.60/2008).   

 

Resource Implications:   None – the costs of the compulsory purchase will be met by WEB
