Misuse of Drugs (Addicts) (Amendment No. 5) (Jersey) Order 2007.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Misuse of Drugs (Addicts) (Amendment No. 5) ( Jersey ) Order 2007

1. Introduction

The Minister has previously approved a recommendation of The Misuse of Drugs Advisory Council (MDAC) that fentanyl, a Class A controlled drug, be added to the list of drugs subject to the provisions of the Misuse of Drugs (Addicts) (Jersey) Order 1980 (MD-HSS-2007-0002). The making of the Misuse of Drugs (Addicts) (Amendment No. 5) (Jersey) Order 2007 achieves this objective.

2. Recommendations of the Misuse of Drugs Advisory Council

The MDAC, after due consideration, recommended the following:

2.1. That fentanyl be added to the list of drugs contained in the Schedule to the Misuse of Drugs (Addicts) (Jersey) Order 1980.

This provision will require any doctor who attends a person who the doctor considers, or has reasonable grounds to suspect, is addicted to fentanyl, to furnish certain details with respect to that person to the Medical Officer of Health unless the doctor is of the opinion that continued administration of fentanyl is required for the purpose of treating organic disease or injury.

2.2. That fentanyl be added Article 3(3) of the Misuse of Drugs (Addicts) (Jersey) Order 1980

This provision will mean that a doctor would be acting illegally if that doctor administered, supplied, authorised the administration or supply or prescribed fentanyl for any person who the doctor considers, or has reasonable grounds to suspect, is addicted to any drug listed in the Schedule to the Order except where it is for the purpose of treating organic disease or injury or under, and in accordance with, the terms of a licence issued by the Minister.

The Minister is requested to make the Misuse of Drugs (Addicts) (Amendment No. 5) (Jersey) Order 2007
