Motor Traffic (Public Service Vehicles (Conditions of Fitness)) (Amendment)(Jersey) Order 2007. Operation of DUKWs as Public Service Vehicles.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for decision:

OPERATION OF AMPHIBIOUS VEHICLES (DUKWs)

Purpose of the Report

To consider the Motor Traffic (Public Service Vehicles (Conditions Of Fitness))(Amendment)(Jersey) Order 2007 which will allow DUKWs to provide char-a-banc services primarily to and from Elizabeth Castle.

Background

On the basis of MD-T-2007-0020, the Law Draftsman has drafted an amendment to Motor Traffic (Public Service Vehicles (Conditions Of Fitness))(Jersey) Order 2003 to permit DUKWs to operate as public service vehicles on approved routes on the Island’s roads.

Discussion

The Law Draftsman was asked to prepare the necessary changes to the Order on the basis of a brief provided by the Department.

The Motor Traffic (Public Service Vehicles (Conditions Of Fitness))(Amendment) (Jersey) Order 2007 is attached for the Minister to make the Order. Making the Order will:-

1. Define DUKW;

2. Exempt DUKWs from the requirement to have the steering wheel on the right of the vehicle;

3. Exempt the driver’s seat of DUKWs and road trains from being in a position that enables hand signals to be made on the off-side of the vehicle from the driver’s seat;

4. Exempt DUKWs from the requirement to have the first fixed step into the vehicle set at a height of not more than 435mm above ground level;

5. Exempt DUKWs from the requirement that the actuating mechanism of an emergency exit can be operated by someone standing on ground level outside the vehicle.

Points 2 and 3 will permit driver position to be in the middle or left of the vehicle.

Points 4 and 5 recognise that by the nature of the vehicle, the passenger deck is considerably higher than ground level. While there may be retractable, aircraft style steps in certain vehicles that can be used in emergencies, it is envisaged that access to the vehicle will normally be via ramps to deck level.

The Order will come into effect seven days after it is made.

Recommendation

The Minister is recommended to make the Motor Traffic (Public Service Vehicles (Conditions Of Fitness))(Amendment)(Jersey) Order 2007.
