Waterfront Pool - Budget Adjustments 2008

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (19.01.2009) to request a budget transfer from Treasury and Resources to Education Sport and Culture Department in respect of operating deficit of the Waterfront Pool in 2008.

Decision(s):

The Minister requested the transfer of £337,000 from the Treasury and Resources department to the Education, Sport and Culture Department’s revenue budget in respect of the operating deficit of the Waterfront Pool in 2008.

Reason(s) for Decision:

In order to provide for the 2008 deficit funding for Serco (Jersey) Ltd in respect of the Waterfront Pool in the 2008 accounts it is necessary to reflect the expected out-turn as a creditor and transfer a budget from Treasury and Resources to cover the payment. This replicates the position adopted in 2006 and 2007.

Other than those detailed in the report there are no further financial or manpower implications.

 

Action required:

To transfer the sum of £337,000 to the ESC department’s revenue budget in respect of the Waterfront Pool.

1.             Introduction

 

The purpose of this report is to ask the Minister to seek additional funding in respect of the Waterfront Pool deficit in 2008.

 

 

2.             Background

 

The latest figures from a report dated 9th January 2009, prepared by James Shepherd, Operations Director, Serco (Jersey) Ltd indicate a net overspend of approximately £342,668 in respect of the operation of the Waterfront Pool for the year 2008.  As a result of some confusion during the course of the year in regard to the amount of subsidy payable monthly by CTP Ltd (the original developers of the Waterfront site) there is still a small credit balance remaining on the Business Unit dealing with the Waterfront Pool, and the sum of £337,000 is required to fund the deficit payment.

 

The Waterfront Pool was transferred to the administration of the Department for Education, Sport and Culture (ESC) from the Waterfront Enterprise Board in the early part of 2005.  At that time a commitment was made by the then Finance and Economics Committee that deficits (which are contractually bound to be paid to Serco (Jersey) Limited) would be funded centrally and that there would be no adverse affects on the ESC budget.

 

The loss for 2006 was £275,456, which was paid to Serco in the early part of 2007 and a budget of £275,000 was transferred from T&R to cover this payment.  A creditor was raised at the end of 2006 to correctly account for the deficit in that year.

 

The loss for 2007 was £297,873, which was paid to Serco in the early part of 2008 and a budget of £298,000 was transferred from T&R to cover this payment.  A creditor was raised at the end of 2007 to correctly account for the deficit in that year.

 

Funding for 2009 has been agreed as an addition to the budget of the ESC department, however, for 2008 the budget remains within the capital allocation held by the Treasury and Resources department.  As such, the Minister for ESC is asked to request the funding from T&R in order that the expected deficit may be accounted for in 2008.

 

A further paper detailing the financial position of the Waterfront Pool will be presented to the Minister prior to any payments being made to Serco.  An invoice requesting payment of the deficit funding has now been received from them.

 

3.             Recommendation

 

It is recommended that the Minister requests the Minister for Treasury and Resources to approve an additional budget allocation from the Waterfront Pool capital reserve to the ESC department’s revenue budget in the sum of £337,000 in respect of the operating deficit for 2008.
