Transfer of Education Officer budget from Education, Sport and Culture to Home Affairs

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

EDUCATION, SPORT AND CULTURE

 

Recommendation to transfer Education Officer Budget to Home Affairs.

 

1.     Introduction

 

The purpose of this paper is to outline the background and circumstances of the transfer of budget of the Education Officer post within Education, Sport and Culture; and to seek Ministerial approval to transfer the funding to the Home Affairs Department from the Education, Sport and Culture Department on a permanent basis.

 

2.     Background

 

2.1 Historically it has been the responsibility of Education, Sport and Culture to provide teaching for those individuals of compulsory school age who are either remanded or sentenced at La Moye Prison.

 

2.2 This responsibility has recently been met by teachers from Greenfields Centre and, previously, Les Chenes School. The Assistant Director for Schools and Colleges took the decision in 2007 to transfer the budget (at MPSU5 plus SA3) to La Moye Prison to more effectively meet the entitlement of these students.

 

2.3 In early 2007 the Head of Evaluation and Standards worked with the Prison Governor following the prison’s external report on current educational provision. It was decided to offer a secondment to a senior teacher to develop and implement a strategic plan for education.

 

2.4 In April 2007 an Assistant Headteacher from Hautlieu was seconded to La Moye Prison for a period of one year. This colleague continued as an employee of ESC for the twelve month period. No budget was transferred to Home Affairs at this time as Hautlieu required funding to replace the seconded colleague. Home Affairs provided the difference in funding between the proposed supplementary allowance and that of the post holder.

 

2.5 In Spring 2008 it was decided to make this seconded appointment permanent. This requires ESC to transfer the budget to Home Affairs with effect from April 2008.

 

 

3.     Recommendation

 

4.1 It is recommended that the Minister agree to the transfer of pro-rated funding equivalent to 1.0 fulltime equivalent (£46,610) with effect from 1st April 2008, with a full year effect of £63,300 from 2009.
