A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment determined that : La Plaisance, La Rue de la Vallée, St Mary be added to the List of Sites of Special Interest

Reason(s) for Decision:

1.     The special interest of the building and place referred to above, as defined and in the schedule and relative to the published criteria for selection, justifies its inclusion on the List of Sites of Special Interest in accordance with the provisions and purposes of the Planning and Building (Jersey) Law 2002 and;

2.     it accords with the States Strategic Plan commitment of protecting and sympathetically managing the Island’s built heritage assets.

Legal and Resource Implications:

Article 51(2)(b) of the Planning and Building (Jersey) Law 2002 enables the Minister to include on the List of Sites of Special Interest those buildings and places that the Minister is satisfied has public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attached to the building or place.

Purpose of the Report

To enable the Minister’s to consider the addition of La Plaisance, La Rue de la Vallée, St Mary to the List of Sites of Special Interest. 

Background and discussion

Following reports of unauthorised works to La Plaisance in September 2009 which, at that time, was a proposed Site of Special Interest, action was taken to add the site to the List of Sites of Special Interest on a provisional basis: notice to this effect was duly served on 29 September 2009, effectively temporarily listing the property for three months. 

It has not been possible to bring this matter before the Minister for his consideration before now as a consequence of which it was necessary to serve another notice, extending the provisional Listing of the site as a Site of Special Interest on 29 December 2009. 

Whilst no formal representations against the proposed Listing of the site have been received from the owners of the site an appeal has been lodged against the service of an Enforcement Notice on the site, relative to the unauthorised works. Whilst this is not material to the consideration of any assessment of the building’s heritage value, it is considered appropriate that the matter of Listing is placed before the Minister for determination. 

Following a detailed assessment of the site by Jersey Heritage a recommendation of adding the site to the List of Sites of Special Interest is made. This has received the unanimous support of the Ministerial Registration and Listing Advisory group.

On the basis of the recommendation of Jersey Heritage to add La Plaisance, La Rue de la Vallée, St Mary to the List of Sites of Special Interest because of its special interest, the Minister is asked to consider the addition of this building and place to the List.
