Road Traffic (St. Brelade) (Jersey) Order 1990: Proposed amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENT REQUEST

 

 

Purpose of the Report

 

To amend the Road Traffic (St Brelade) (Jersey) Order 1990

 

 

Background

 

La Rue Voisin connects Le Chemin du Portelet with the privately owned road that extends down to the new Portelet Bay Development.  The road also provides access to residential developments.  Following a period of consultation with local residents and subsequent discussion with the Parish of St Brelade with regard to waiting restrictions on La Rue Voisin, it was agreed that the Minister for TTS be requested to approve an amendment to the Road Traffic (St Brelade) Order to allow waiting in certain areas of the road.  

 

 

Discussion

 

Waiting is presently prohibited along both sides of all of La Rue Voisin, by Order, although the road is not marked with the yellow “prohibition of waiting” lines and the prohibition has not been enforced.  However, with the completion of new housing and the completion of the Portelet Bay Apartments the Parish considers it necessary to allow some areas of legal waiting and to mark yellow lines along all areas where waiting should still be prohibited.

 

The proposed prohibition areas are as follows and can be seen on the attached plan:

 

257 Yards (235 metres) on the Eastern side of La Rue Voisin

58 Yards (53 metres) on the western side from the new development to the first private development north of this location known as “The Palms”

 

Prohibition of waiting lines have already been placed at some junctions with the private developments in accordance with Article 4(2) of the Order which prohibits waiting within 10 yards of a junction.

 

 

Recommendation

 

The Minister is requested to approve the request.
