A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Transfer of Public Health budgets from Health and Social Services Department to the Community and Constitutional Affairs Department and the Chief Minister’s Department
Decision(s): The Minister decided to: a) Rescind decision MD-HSS-2016-0068, relating to this proposed transfer being effective from 2016, on the basis that the same transfer is instead being enacted from 2017 through this Ministerial Decision. b) approve the transfer of a net recurring revenue budget of £896,300 from the Health and Social Services Department to the Community and Constitutional Affairs Department (in respect of strategic public health, to include the Medical Officer for Health, and professional and care regulation); and £164,200 from the Health and Social Services Department to the Statistics Unit, Chief Minister’s Department (in respect of the statistical functions for public health); both with effect from 1st January, 2017; and any restructuring amounts approved for the transferred functions.
This decision is taken for a number of reasons, but most prominently; To position strategic public health, and professional and care regulation, separate from the delivery of health care; and to enhance joint working with related policy and regulatory functions, including wider social and housing policy, so as to support the wider strategic objective of ‘tackling the wider determinates of health’. To position the production of health statistics within the independent statistics unit, helping the production of health statistics to be integrated into their schedule of releases, and to benefit from the independence and expertise of the statistics unit and the oversight of the independent statistics users group.
Resource Implications: The Health and Social Services Department’s recurring revenue head of expenditure will decrease by £1,060,500 and 15 FTE with effect from 1st January, 2017; the Community and Constitutional Affairs Department’s recurring revenue head of expenditure will increase by £896,300 and 12 FTE with effect from the 1st January, 2017; the Chief Minister’s Department recurring revenue head of expenditure will increase by £164,200 and 3 FTE with effect from the 1st January, 2017; and any restructuring amounts approved for the transferred functions will also be transferred. This decision does not result in an increase to the net revenue budget or overall FTE of the States.
Action required: Assistant Director of Finance to forward a copy of the signed MD to the Decision Support Officer, Treasury, to the Director of Finance, CCA and to the Director of Finance – Corporate Group.
