Sea Fisheries (Trawling, Netting and Dredging) (Amendment No.3) (Jersey) Regulations 200-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (04.03.09) to approve that the draft Sea Fisheries (Trawling, Netting and Dredging) (Amendment No.3) (Jersey) Regulations 200- be transmitted to the UK Ministry of Justice for approval.

The Regulations have now been drafted and prior to their being lodged for approval by the States Assembly, it is necessary for them to be approved by the UK Secretary of State.

Purpose of the Report

To obtain UK Secretary of State approval for the draft Sea Fisheries (Trawling, Netting and Dredging) (Amendment No 3) (Jersey) Regulations 200 -

Background

On 12th November 2008, Senator P Ozouf approved that drafting commence of an amendment to the Sea Fisheries (Trawling, Netting and Dredging) (Jersey) Regulations 2001.

The amendment was necessary to introduce restrictions on the amount of scallop dredges that can be towed by any one vessel, as recommended by the Joint Management Committee established under the Agreement for Fishing in the Bay of Granville.

On 13th November 2008, Senator P Ozouf approved that drafting commence of a further amendment to the Sea Fisheries (Trawling, Netting and Dredging) (Jersey) Regulations 2001.

This amendment was necessary to introduce a new method of measuring the mesh size of both trawl and static fishing nets, to keep Jersey fisheries management in line with that of Europe. The new method is an improvement on the existing method and is the result of significant research and consultation.

A minor amendment has also been made to exempt from the mesh size requirements traditional prawn nets pushed by hand.

Discussion


Draft regulations have now been prepared and meet the requirements of the drafting instructions.

Under the terms of the Jersey/UK Fisheries Management Agreement and the Sea Fisheries (Jersey) Law 1994, Jersey is obliged to obtain UK Secretary of State approval for fisheries regulations that apply throughout the Island’s territorial sea. 

Recommendation

The Minister is requested to approve the revised draft Sea Fisheries (Trawling, Netting and Dredging) (Amendment No 3) (Jersey) Regulations 200 – and authorise their transmission to the UK for Secretary of State Approval.
