Food Costs Bonus (Jersey) Regulations 201- - Amendment to Draft

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved and decided to lodge ‘au Greffe’ an amendment to the Draft Food Costs Bonus (Jersey) Regulations 201-

Reason(s) for Decision:  This amendment amends the Draft Food Costs Bonus (Jersey) Regulations 201- to allow the existing Regulations to be cancelled and the new Regulations to be brought into force within seven days.

Resource Implications: There are no additional resource implications associated with the amendment to the Regulations.

Action required: Policy and Strategy Director to request the Greffier of the States to arrange for the draft legislation to be lodged 'au Greffe' and to request a States debate at the earliest possible opportunity.

Food Costs Bonus (Jersey) Regulations 201- - Amendment to Draft

Report

 

The current triennial Food Costs Bonus Regulations will expire on 23 July 2011.  A further set of triennial Regulations have been drafted and lodged as P.65/2011.  These Regulations are due to come into force on 24 July 2011.

 

This amendment to the triennial Regulations allows for the repealing of the existing Regulations and for the new Regulations to come into force 7 days after they have been agreed.

 

Subject to the approval of the States, this would allow applications for the Food Costs Bonus for 2011 to be made one week after the date of the States’ debate.

 

The value of the proposed Bonus for 2011 is £193.36.

 

 

Financial and Manpower considerations

 

There are no additional financial or manpower considerations in respect of this amendment. 

 

As set out in P.65/2011, based on a current uptake of approximately 2,000 claims per annum, the departmental cash limit includes an allocation of £386,000 for the Food Costs Bonus in 2011.
