Tourism Development Fund: Grant: The Lido (Havre des Pas) Limited

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Tourism Development Fund – Approval of grants to support The Lido (Havre des Pas) Limited with the renovation of the Lido building at Havre des Pas.

Decision(s):

The Minister approved the award of grants, subject to contract and conditions, from the Tourism Development Fund of –

a)      a sum not exceeding £4,815 for the purposes of supporting The Lido (Havre des Pas) Limited with the renovation of the Lido building at Havre des Pas

b)      a further sum not exceeding £35,000 for the purposes of replacing bi-fold doors at the above property, the release of the latter sum to be conditional on the applicant’s securing of landlord’s consent not later than 30th June 2017 for their replacement.

Reason(s) for Decision:

Following a recommendation by the Tourism Development Fund Advisory Panel, the Minister approved the offer of grants, subject to contract and conditions, from the Tourism Development Fund to support The Lido (Havre des Pas) Limited with the renovation of the Lido building at Havre des Pas.

Resource Implications:

The grants will be made from the Tourism Development Fund, which has sufficient resources to cover the grants. There are no further manpower or resource implications.

Action required:

The Minister to instruct the Assistant Director to issue the Grant Agreement in accordance with Financial Direction 5.5 ‘Management of Grants’.

Recommendation

At its meeting on 5th April 2017 the Tourism Development Fund (TDF) Advisory Panel agreed to recommend the award of funding up to £49,815 to The Lido (Havre des Pas) Limited towards a programme of works it planned to carry out at the venue. Specifically, the recommendation covered:

-          The renovation of the toilets (up to £10,000)

-          A new exit door (up to £3,315)

-          New windows (up to £35,000)

-          A history exhibit (up to £1,500)

As part of the necessary checks against Financial Directions the Department were advised that both the windows and the toilets formed part of improvements made to the venue by the landlord in 2012 and in 2015 and are classified as being fit for purpose. In addition, as a request is yet to be made by the tenant, Jersey Property Holdings would not be willing to provide landlords consent for the replacement of the Bi-Fold doors at this time. If this position changes before the end of June 2017 then a further application for up to £35,000 to replace the Bi-Fold doors will not be necessary and a separate grant agreement will be offered.

So as not to cause undue delay, the recommendation to the Minister for Economic Development. Tourism, Sport and Culture is that a grant is offered up to £4,815, subject to a number of pre-conditions, to support the installation of a new fire door to increase the capacity of the venue and the installation of a historical exhibit as detailed in the application. The offer of a grant of this nature would constitute appropriate further public support under the TDF as it enables the venue to increase capacity in support of the vision and plans submitted to successfully secure the lease through a competitive tender process in 2015.
