Capital Reserve Budget Transfers.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

  1. Purpose of Report
  2. The Minister is asked to approve budget transfers from the Capital Reserve in respect of three projects of the Health and Social Services Department.
  3. The Minister is also asked to consider a process for delegating future transfers.

 

  1. Background
  2. The final account process has been completed for the following Health and Social Services Department capital projects, resulting in a requirement to transfer funds previously identified and held in the capital reserve:
  • Overdale Rehabilitation Unit (JZ0005) £155,680
  • Community Dental Clinic   £28,000
  1. A further sum of £60,427, also previously identified in the Capital Reserve, is required in respect of the deleted Belle Vue Nursing Home project (JZ0019) to meet the cost of outstanding fees items.
  1. All these sums have been reviewed and agreed by the States Chief Quantity Surveyor.

 

  1. Comments
  1.  These budget transfers are required to enable the Heads of Expenditure to be closed.
  2.  The budget sums held in the Capital Reserve are not ‘new’ items, but represent sums retained in respect of inflation that have been approved by the States in the Annual Business Plan but can only be allocated once ascertained.
  3.  It is, therefore, proposed that a scheme of delegation to deal with budget transfers for inflation is implemented, which requires the Minister to only consider those items where the sum exceeds £100,000 and is not within the budget allocation held in the Capital Reserve.
  4. The proposed delegation is set out in Appendix A.

 

  1. Recommendation
  2. That the Minister approves the budget transfers from the Capital Reserve in respect of three projects detailed above, and
  3. That the Minister approves the proposed scheme of delegation for dealing with future budget transfers from the Capital Reserve for inflation items.

 

  1. Reason for Decision
  2. The budget transfers have been vouched and are required to enable the Heads of Expenditure to be closed.
  3. The proposed scheme of delegation will reduce the number of requests to the Minister for budget transfers in respect of sums held in the Capital Reserve that form part of the capital sum approved by the States.
