Amendments to the List of Sites of Special Interest
Purpose of the Report
The purpose of this report is for the Minister to confirm the following scheduled amendments the List of Sites of Special Interest. The report addresses decisions made in the 1970s to designate buildings as Sites of Special Interest and subsequent decisions of the former Jersey Building Heritage Sub-Committee to review them.
Background
The former Island Development Committee designated a number of properties in St Helier as Sites of Special Interest in 1972, and at Gorey Pier in 1974. These were some of the first registered buildings in Jersey and were designated at a time when the only formal means of protection for historic buildings was represented by SSI designation. The Jersey Building Heritage Sub-Committee carried out a review of the Register between 1998-2002 and identified that some of the Sites of Special Interest designated in the early 1970s did not have sufficient special interest to meet the current SSI listing criteria. Although some maintained sufficient architectural and historical interest to satisfy the criteria for inclusion on the Register as Buildings of Local Interest others no longer merited Registration. The following schedule sets out those recommendations (with some address corrections):

On 16 March 2007 and 10 April 2007 the Minister confirmed his intention to remove the above scheduled properties from the List and to maintain those identified on the Register as Buildings of Local Interest. Notices of Intention and letters of notification in accordance with the schedule were issued to the owners of the properties and Site Notices placed at Gorey pier, The Parade and Vine Street on 10 April 2007. These notices gave owners and interested parties 28 days to submit representations about the removal of the properties from The List.
1 representation has been received (attached): registering objection to the removal of ‘special interest’ from the properties on Gorey Pier and states that the site notice was inadequately displayed.
Discussion:
The representation gives no justification for objection based on the published criteria against which the assessment needs to be, and has been made.
Article 51(7) of the Planning and Building Jersey Law (2002) requires a notice to be served either (a) on the owner of the building; or (b) by displaying it in a conspicuous place in or near the building or place. A letter with the notice of intention was sent to ‘the owner’ at each address of each property to which the report relates (some 150 letters in total); the service of site notices was undertaken by the department as an additional measure in order to ensure that interested parties were made aware of the Minister’s intention to remove the buildings from the List. The site notice is considered to have been fixed in a sufficiently conspicuous location in each instance.
Recommendation
It is recommended that the Minister for Planning and Environment resolves to:
· Confirm the removal of the above scheduled properties from the List of Sites of Special Interest, and;
· Confirm the retention of the properties scheduled above as ‘Register as BLI’ on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as Buildings of Local Interest
Reason(s) for Decision
The decision gives statutory effect to those made on 16 March 2007 and 10 April 2007.
