Shipping (Survey and Certification) (Jersey) Order 2013

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister made the Shipping (Survey and Certification) (Jersey) Order 2013. (“the Order”)

 

Reason(s) for Decision:

 

  • As a result of agreement with the United Kingdom it will now be possible for commercial ships up to 400gt to be registered in Jersey. This means that the current Shipping (Survey and Certification) (No. 2) (Jersey) Order 2005 needs to be extended to provide better provision for those ships, primarily in the range 150gt to 400gt, which are not covered by other legislation.
  • The Minister requested preparation of the amending Order by Ministerial Decision MD-E-2013-0008 on 21 January 2013. The amendment has now been prepared and is ready for signature.

 

Resource Implications:

The associated additional survey and certification work which may arise will be carried out by approved Recognised Organisations or within existing Shipping Registry resources. The work is carried out on a fee basis and there are therefore no additional resource implications arising from this decision.

 

Action required:  

The Greffier is requested to take the necessary action for notifying the States Assembly and for publication of the Order.

SHIPPING (Survey and Certification) (JERSEY) ORDER 2013

 

Report

 

 

Background

 

The Shipping (Survey and Certification) (No.2) (Jersey) Order 2005 has provided a regime that has covered Jersey ship surveys for the last eight years. It was specifically adapted from legislation in the United Kingdom to give the legal basis for the survey of local domestic passenger craft, such as the Elizabeth Castle ferries and the excursion boat Southern Bay Rose. It also provided the means of ensuring the right certification was in place for non-Jersey commercial shipping coming and going from the Island.

 

However, the original United Kingdom legislation has since been up-dated leaving the Jersey legislation in need of amendment if it is to maintain modern international safety standards. Most importantly, the UK has also recently passed an amendment Categorisation Order (The Merchant Shipping (Categorisation of Relevant British Possessions) (Amendment) Order 2013. This will allow Jersey to register commercial vessels up to 400gt and not the present limit of 150gt. This change can only be accommodated by extending the provisions in the Jersey 2005 Order.

 

Considerations

 

In the immediate future, the main focus of the shipping register in Jersey will continue to be the pleasure yacht market both for commercial charter and private usage. Nevertheless, local business interest may wish to register a small cargo vessel in Jersey or indeed run local passenger services in the Islands or between the Islands and France. UK provisions, suitably modified have thus been incorporated into the Order.

 

Extension of the provisions also covers the possibility that a Jersey surveyor would survey and certificate non-Jersey ships on request. This has been added so as to provide additional opportunities for growth of the shipping business in the Island.

 

The Order

 

The Order will revoke and replace the existing Order with additional scope. In particular, the following areas are now added to the scope of the Order as being applicable to commercial shipping in whole or in part if the vessel is over 150gt:

 

  • Cargo ship radio surveys,
  • Cargo ship structure, machinery and equipment surveys,
  • Passenger ship surveys for short international voyages,
  • Surveys of non-Jersey ships.

 

The Order is now ready for signing and should come into force at the same time as the associated amending Fees Order.
