New Bellozanne Sewage Treatment Works: Contract 10502/09 Existing Bellozanne Ultra Violet Treatment Building Refurbishment: Additional Civil Design and Construction Works to Main Contract

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  New Bellozanne Sewage Treatment Works – Existing Bellozanne Ultra Violet (UV) Treatment Building Refurbishment. Additional Civil Design and Construction Works to Main Contract.

Decision(s):  The Minister approved the instruction to nmcn PLC for the additional works in the sum of £153,277.26 in order to allow works to refurbish the existing UV building to be completed as part of the current Sewage Treatment Works contract.

Reason(s) for Decision: Carrying out the works after commissioning of Phase 1A, rather than as a separate contract after the new Sewage Treatment Works has been completed, will avoid more construction disruption for Sewage  Treatment Works Operations, and because nmcn PLC are already mobilised on site, installation costs overall can be significantly reduced.

The proposal also has the added advantage that the Motor Control Centre (MCC) for the new storm storage and sludge storage facilities, which are to be constructed under Phase 1B of the Sewage  Treatment Works contract, can be housed in the refurbished building, thus saving on the cost of a new kiosk for the MCC.

Resource Implications:  Sufficient funds are available in a separate Capital Vote, Q00GP20017 -Replacement Assets and Minor Capital in 2020, so funding of the new Sewage Treatment Works project will not be impacted.

Action required: Director General of Infrastructure, Housing and Environment to authorise the Project Manager to issue an instruction to nmcn PLC for the additional works in the sum of £153,277.26 to allow works to refurbish the existing UV building to be completed as part of the current Sewage Treatment Works contract.
