2007 year-end carry forwards as endorsed by the Council of Ministers.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: 

The 2007 year end carry forwards as endorsed by the Council of Ministers.

Decision(s):

The Minister approved the following departments’ requests to carry forward their surplus balances from 2007 to 2008:

  • Chief Minister’s Department: £8,592;
  • Education Sport and Culture: £626,880;
  • Health and Social Services: £6,143;
  • Planning and Environment: £43,373;
  • States Assembly: £30,000;
  • Transport and Technical Services: £242,969;
  • Overseas Aid: £17,646;
  • Bailiff’s Chambers: £6,178;
  • Law Officers: £20,839;
  • Judicial Greffe: £24,109;
  • Office of The Lieutenant Governor: £864; and
  • Comptroller and Auditor General £122,807.

 

The Minister approved the transfers:

  1. Of the remaining States surplus of £1,407,161 to the Contingency Fund detailed as follows:
  • From Economic Development: £5,655;
  • From Education Sport and Culture: £16,969;
  • From Housing: £407,037;
  • From Planning and Environment: £23,682;
  • From States Assembly: £310,175;
  • From Treasury and Resources: £8,128;
  • From Viscount’s Department: £601,236;
  • From Official Analyst: £27,367;
  • From Probation: £6,912.
  1. And of the £1,407,161 from the Contingency Fund to the following departments in accordance with the additional funding and carry forwards as agreed by the Council of Ministers:
  • Economic Development: £20,000;
  • Social Security: £267,000;
  • Data Protection Commission: £20,000;
  • Comptroller and Auditor General: £195,000; and
  • Law Officers: £55,161.

 

The Minister also approved the sum of £850,000, allocated to the Prison, to remain in the Contingency Fund until such time as it is required by the Home Affairs Department.

Reason(s) for Decision:

To enable the appropriate transfers of funds to be made.

Resource Implications: 

Other than those detailed in the report there are no further financial or manpower Implications.

Action required:

Treasury Officers to inform departments of the decision and action the associated transfers of funds.
