Health and Social Services (2009 Fees) (Jersey) Order 200-
Explanatory Note
This Order increases by, approximately 2.5%, the following fees –
(a) the fees connected with registration authorizing the carrying on of a nursing home, mental nursing home or residential home;
(b) the fees connected with the grant, renewal or transfer of a licence to conduct a nursing agency;
(c) the fees in relation to the rolls of ancillary dental workers;
(d) the fee for a licence to sell ice-cream from a van or stall;
(e) the maximum fee that a registered medical practitioner may charge for completing a medical certificate to accompany an application for cremation.
These fees were last increased on 1st January 2008.
This Order increases, by approximately 10%, the fee for cremation of a person aged 18 or more. The fee was last increased on 1st January 2008. There is no fee for the cremation of a person under that age.
This Order increases, by approximately 3.7%, the hospital charges for long-stay patients. The fees were last increased on 1st October 2007.
All of the increases take effect on 1st January 2009.

THE MINISTER FOR HEALTH AND SOCIAL SERVICES, in pursuance of Articles 4 and 15 of the Nursing and Residential Homes (Jersey) Law 1994, Articles 2 and 6 of the Nursing Agencies (Jersey) Law 1978, Article 10(8) of the Dentists Registration (Jersey) Law 1961, Articles 20 and 58 of the Food Safety (Jersey) Law 1966, Article 4 of the Cremation (Jersey) Law 1953 and Article 2 of the Hospital Charges (Long-Stay Patients) (Jersey) Law 1999 orders as follows –
1 Food Safety (Ice-Cream Stalls etc.) (Jersey) Order 1969 amended
In Article 3(2) of the Food Safety (Ice-Cream Stalls etc.) (Jersey) Order 1969 for the amount “£94.75” there shall be substituted the amount “£97.25”.
2 Nursing Agencies (General Provisions) (Jersey) Order 1978 amended
For paragraphs (2) and (3) of Article 2 of the Nursing Agencies (General Provisions) (Jersey) Order 1978 there shall be substituted the following paragraphs –
“(2) Subject to paragraph (3), the appropriate fee for a licence shall be £235 in the case of a first application for a licence and £116 in the case of renewal of a licence by the same person in respect of the same premises.
(3) Where the application is made by reason only that it is proposed to carry on an agency in respect of which a licence is held on different premises, the fee shall be £92.50.”.
3 Nursing Homes and Mental Nursing Homes (General Provisions) (Jersey) Order 1995 amended
In the Nursing Homes and Mental Nursing Homes (General Provisions) (Jersey) Order 1995 –
(a) in Article 3 –
(i) in paragraph (a) for the amount “£66.50” there shall be substituted the amount “£68.25”,
(ii) in paragraph (b) for the amount”£157.25” there shall be substituted the amount “£161.25”;
(b) in Article 4(1) for the amount “£80.50” there shall be substituted the amount “£82.50”.
4 Residential Homes (General Provisions) (Jersey) Order 1995 amended
In the Residential Homes (General Provisions) (Jersey) Order 1995 –
(a) in Article 3 –
(i) in paragraph (a) for the amount “£66.50” there shall be substituted the amount “£68.25”,
(ii) in paragraph (b) for the amount”£157.25” there shall be substituted the amount “£161.25”;
(b) in Article 4(1) for the amount “£80.50” there shall be substituted the amount “£82.50”.
5 Dentists (Ancillary Dental Workers - Fees) (Jersey) Order 2007 amended
In Article 1 of the Dentists (Ancillary Dental Workers - Fees) (Jersey) Order 2007 –
(a) in paragraph (a) for the amount “£40.00” there shall be substituted the amount “£41”;
(b) in paragraph (b) for the amount “£23.50” there shall be substituted the amount “£24.25”;
(c) in paragraph (c) for the amount “£40.00” there shall be substituted the amount “£41”.
6 Cremation (Fees) (Jersey) Order 2007 amended
In the Cremation (Fees) (Jersey) Order 2007 –
(a) in Article 1(b) for the amount “£288” there shall be substituted the amount “£317”;
(b) in Article 2 for the amount “£46” there shall be substituted the amount “£47.25”.
7 Hospital Charges (Long-Stay Patients) (Jersey) Order 2007 amended
In the Hospital Charges (Long-Stay Patients) (Jersey) Order 2007 for Article 1(1) there shall be substituted the following paragraph –
“(1) Except as provided by paragraph (2), where a hospital provides accommodation services to a long-stay patient over the age of 65, the Minister shall make and recover from the patient a charge for the provision of the services of £438.20 a week or, in the case of any period of less than a week, £62.60 a day.”.
8 Revocations
The following Orders are revoked –
(a) Food Safety (Ice-Cream Stalls etc.) (Amendment No. 28) (Jersey) Order 2007;
(b) Nursing Agencies (General Provisions) (Amendment No. 23) (Jersey) Order 2007;
(c) Nursing Homes and Mental Nursing Homes (General Provisions) (Amendment No. 15) (Jersey) Order 2007;
(d) Residential Homes (General Provisions) (Amendment No. 14) (Jersey) Order 2007.
9 Citation and commencement
This Order may be cited as the Health and Social Services (2009 Fees) (Jersey) Order 200- and shall come into force on 1st January 2009
