Rescindment of Housing Policy HD17: Tenants in Arrears with Assets

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Resource Implications:   None. Policy HD4 ‘Rent Arrears Policy’ sufficiently supports the department’s current arrears recovery strategy.

REPORT FOR THE HOUSING MINISTER  

Recommendation to rescind Policy HD17 – Tenants in Arrears With Assets.  

Purpose of the Report  

To request approval for Policy HD17 to be removed from the Housing Department’s active Policy Register. 

Background  

  1. Policy HD17 was approved by the Housing Minister on 30th April 2007 under Ministerial Decision MD-H-2007-0028.

 

  1. At that time, the Housing Department administered the Rent Abatement Scheme which offered information regarding those assets at the disposal of applicants. Policy HD17 was designed to apply such information for the purposes of rental arrears recovery where practical and appropriate to do so.

 

  1. On 28th January 2008 the Rent Abatement Scheme ceased to exist following the implementation of the Income Support Scheme now administered by the Social Security Department. All matters of financial information for existing tenants are now received by the Social Security Department and the information required to enforce the provisions of Policy HD17 is no longer made available to the Housing Department.

 

  1. Wherever possible, tenants experiencing rental arrears are managed within the provisions of Policy HD4 the ‘Rent Arrears Policy’. Such action includes the gathering of financial information with consent of the tenant and using this information to create a manageable repayment scheme, Petty Debt Court action and in liaison with the Viscounts Department where further action is desirable.

 

Recommendation 

Given that Policy HD17 is therefore no longer effective or appropriate for the management of rental arrears, it is recommended that the Housing Minister rescind this policy.
