Budget transfer: Vulnerable Adults Policy Group - Protection Committee - Children's Policy Group

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Establishing a Vulnerable Adults Policy Group and Jersey Vulnerable Adults Protection Committee by way of transferring budget from 2012 Central Reserves to the Chief Minister’s Department; and transferring budget from the Health and Social Services Department 2013 – 2015 budget allocation to the Chief Minister’s Department in respect of the Children’s Policy Group and Children’s Protection Committee in anticipation of a transfer of political responsibility in due course.

Decision(s):  In accordance with a decision taken by the Council of Ministers on 4th October, to establish a Vulnerable Adults Policy Group and Jersey Vulnerable Adults Protection Committee by way of transferring budget from 2012 Central Reserves to the Chief Minister’s Department; and transferring budget from the Health and Social Services Department 2013 – 2015 budget allocation to the Chief Minister’s Department in respect of the Children’s Policy Group and Children’s Protection Committee in anticipation of a transfer of political responsibility in due course.

Reason(s) for Decision:  To establish a Vulnerable Adults Policy Group and Jersey Vulnerable Adults Protection Committee to provide political co-ordination across Departments in relation to policies that effect vulnerable adults, and to co-ordinate safeguarding activities in order to ensure that vulnerable adults are afforded sufficient protection. In addition, and by association, to transfer budget and FTE for the CPG and the JCPC to CMD to ensure the aligned and efficient provision of policy and protection activities in relation to both children and adults . Note; the HSSD Minister will remain as the Chair of CPG meetings until the point at which the Vulnerable Adults functions are fully established.

Resource Implications:  To increase the Chief Minister’s Department revenue head of expenditure by £475,110 in 2012 by way of a transfer from Central Reserves (and to increase the Chief Minister’s Department FTE by 1.5 in respect of the creation of the Jersey Vulnerable Adults Protection Committee); and to increase the Chief Minister’s Department revenue head of expenditure by £824,040 for the period 2013 – 2015 by way of a transfer from the Health and Social Services Department (and to correspondingly increase the Chief Minister’s Department FTE by 3.45 in relation to the transfer of the Executive Officer for Children’s Policy and for the Children’s Policy Protection Committee from the Health and Social Services Department).

Action required:  Finance Director– Corporate Group and Director – Financial Planning and Performance to action the transfer.

Treasury & Resources to transfer monies from HSSD revenue head of expenditure to CMD head of expenditure.
