A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s)

The Minister refused the request to alter this permission and advised that an Enforcement

Notice should be issued Article 40(2) of the Planning and Building (Jersey) Law, 2002

Reason(s) for decision:

Following investigations by Environmental Health it has been proven that both hand sorting and mechanical sorting of skips results in an unacceptable noise nuisance.

The use in its entirety should cease as it is unlikely that the operation can be made to comply with acceptable noise levels that would not cause a nuisance to neighbouring residential occupiers.

The hours of operation of ‘Reg’s Skips Limited’ should be limited to those authorised in condition 4 of planning permit P/2005/0423.

NOTICE

 

 

1. THIS IS A FORMAL NOTICE issued by the Minister for Planning and Environment ("the Minister") pursuant to the powers conferred on him by Article 40(2) of the Planning and Building (Jersey) Law, 2002;

2. The Minister, on the 9th January 2007, considered the unauthorised intensification of the commercial sorting of mixed skips by the company named ‘Reg’s Skips Limited’, together with the unauthorised increase in permitted operating hours and the use of a mechanical digger to assist in the sorting of skips.

3 THE MINISTER HEREBY GIVES YOU NOTICE TO CARRY OUT THE FOLLOWING WORKS: To cease the employment of a mechanical digger in connection with the company’s sorting of mixed skips. To cease the said intensification of operations and reduce the quantity of skip sorting to that described within condition 1 of planning permit P/2005/0423. Limit the hours of operation of ‘Reg’s Skips Limited’ to those authorised in condition 4 of planning permit P/2005/0423.

6. WHAT WILL HAPPEN IF THIS NOTICE IS NOT COMPLIED WITH: In accordance with Article 44 of the aforesaid Law, papers will be dispatched to the Law Officers’ Department for the purpose of prosecution against you.

7. WHAT YOUR RIGHTS ARE: In accordance with Article 117 of the aforesaid Law, you may appeal to the Royal Court, within 28 days of the serving of this notice.
