Approval of plan: Weighbridge - Lease to Waterfront Enterprise Board.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (21/08/2006) regarding Weighbridge, Caledonia Place, St. Helier.  Approval of a new plan showing the area of land to be included in the proposed lease to the Waterfront Enterprise Board Limited approved by the States Assembly under Project P45/2002.

Title

Weighbridge Caledonia Place St Helier. Approval of a new plan showing the area of land to be included in the proposed lease to the Waterfront Enterprise Board Limited approved by the States Assembly under Projet P45/2002.

Decision(s):

1. With reference to the approval by the States Assembly of Projet P45/2002 on the 23 April 2002, to agree to the revised area of land as shown on drawing No 372/1/2006 to be leased to the Waterfront Enterprise Board Limited.

2. Under Standing Order 168 (1) (c) and 168 (3) the Minister for Treasury and Resources hereby notifies the States that he has accepted the recommendation of Property Holdings to agree to the above land transaction.

3. Under Standing Order 168 (5) the Minister hereby authorises the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the public.

After the expiry of 15 days following presentation to the States the transaction may be concluded.

Reason(s) for decision:

It was necessary to produce a plan that more accurately represents the area of land to be leased under the proposed lease to Waterfront Enterprise Board Limited approved by the States Assembly on the 23 April 2002.

Under Standing Order 168 (1) (c) and 168 (3) the Minister is required to notify the States of his acceptance of recommendations to dispose, acquire, let or rent land on behalf of the Public of Jersey.

Action required:

Director of Property Holdings to request the Greffier of the States to notify the States of the above decision.

Property Holdings to request the Law Officers’ Department to draft the contract and arrange for it to passed before the Royal Court.

Purpose

To seek the Minister for Treasury and Resources’ approval for a new plan representing more accurately the area of land to be included as the demised premise in the proposed lease approved by the States Assembly under Projet P45/2002 on the 23 April 2002.

Background

The States Assembly approved the leases to the Waterfront Enterprise Board Limited for six areas of land in relation to the Waterfront development. One lease that has not been completed relates to the area known as the Weighbridge, Caledonia Place, St Helier. The original approved drawing requires updating and amending to more accurately represent this demised premise and as such a new plan has been prepared and is attached hereto Drawing No 372/1/2006.

Conclusion

The drawing referred to above is recommended by Property Holdings in association and with the support of the Waterfront Enterprise Board Limited to represent more accurately that area of land being leased.

Recommendation

With reference to the approval by the States Assembly of Projet P45/2002 on the 23 April 2002, it is recommended that the Minister for Treasury and Resources gives approval for Drawing No 372/1/2006 showing the area of land to be leased to the Waterfront Enterprise Board Limited.
