Department for Infrastructure - 2019 Departmental Fees and Charges

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister approved the Department’s fees and charges as set out in the attached schedule.

 

Reason(s) for Decision:  To enable the Department to increase its fees and charges by an average of 2.5% from 1 January 2019 in order to meet cash limits and aid towards cost recovery.

This Ministerial Decision excludes the charges for Jersey Car Parks which will be under a separate Ministerial Decision.

 

Resource Implications:  The additional income as a result of the proposed increases to fees and charges will enable the Department to meet cash limits and aid towards cost recovery.

 

Action required:  The Finance Director to arrange for the Department’s fees and charges to be advertised on www.gov.je.

DEPARTMENT FOR INFRASTRUCTURE – 2019 DEPARTMENTAL FEES AND

 

CHARGES

 

Purpose of Report

The Minister for Infrastructure (DfI) is asked to approve a request to amend the Department’s various fees and charges for 2019 (a schedule of charges is attached as Appendix A).

 

 

Discussion

The proposed increases have been limited to 2.5% per annum in line with FD 4.1 “Increases in States Fees and Charges”.

 

Driver and Vehicle Standards charges (excluding the Motorcycle (CBT) fee above) have been rounded to the nearest £ wherever possible and this has resulted in a small number of charges increasing above 2.5%.  However, these charges are relatively low in terms of income generation and the weighted average increase for DVS is actually below 2.5%.

 

As in previous years, the fees and charges for Jersey Car Parks have not been included as part of this Ministerial Decision but will be brought to the Minister for consideration as a separate report.

 

The Treasury have reviewed the charges and are content that they do not require consideration by the Minister for Treasury and Resources.

 

 

Recommendation

That the Minister approves the fees and charges for 2019 as laid out in the attached Appendix A. That the Minister requests the Finance Director to arrange for the Department’s fees and charges to be advertised on the States Website, www.gov.je, and to be available on request from the department.

To enable the Department to increase its fees and charges by an average of 2.5% for 2019.

 

 

Resource Implications

The increased income will aid towards cost recovery for services.
