Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved signature of the long term Partnership Agreement between the Department and Digital Jersey Limited and accepted the 2014 Digital Jersey Business Plan, including the organisations targets, outputs and deliverables.
Reason(s) for Decision: The Department has agreed 2013 grant funding under a number of interim funding Agreements. A new longer term Agreement (2014 -16) has now been agreed between the Department and the company, along with the contents of a 2014 Business Plan which the Minister has agreed can be signed by the Department’s Accounting Officer

Digital Jersey Partnership Agreement (2014-16) and 2014 Business Plan

Digital Jersey Limited (DJL) was established following a Ministerial Decision (MD-E-2012-0015) dated 28th March 2012, and attached Report “Plan for Growth in a New Digital Economy”.

The organisation was grant funded by the Department in 2013 under two Interim Partnership Agreements, whilst Digital Jersey devised and developed a long term strategic visioning document “Developing a Digital Jersey”, published in October 2013. This document sets out the longer term strategic aims and objectives of Digital Jersey and has formed the basis for undertaking a thorough consultation with on and off Island interests to determine the shape of the organisations activity between 2014 and 2020.

The Department delayed entering into a longer term Partnership Agreement until “Developing a Digital Jersey” was published and a framework for medium term activity was agreed between the Minister and DJL. Digital Jersey has also now brought forward its 2014 Business Plan - based upon activity included in “Developing a Digital Jersey” - which the Minister and Department’s Officers have now had chance to review and which in turn forms Section 3 of the Agreement and is revised on an annual basis.

The Minister has now approved the Partnership Agreement 2014-16 for signature by the Department’s Accounting Officer and accepted the contents of the 2014 Digital Jersey Business Plan, putting the Department into a position whereby it can grant fund DJL to the agreed level in 2014.
