Jersey Car Parks: Victoria Avenue Lay-By 5

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

12 x 3 HOUR MAXIMUM STAY SPACES IN VICTORIA AVENUE LAY-BY 5

 

 

Purpose of the Report

 

To request the 12 x 3 hour maximum stay spaces in Victoria Avenue Lay-by 5 be made permanent at the end of the trial period.

 

 

Discussion

 

A recent trial of 12 spaces being changed to 3 hour maximum stay in Victoria Avenue Lay-By 5 has proved to be successful with positive comments being received from members of the public (MD-T-2018-0047 relates).  During the trial, use of these bays has been monitored and they have been well used.

 

The trial is due to finish on 31st March 2019.  Officers would support the trial being made permanent so the 12 bays remain 3 hour maximum stay. These would be free during the period the seasonal car parks are not chargeable – 1st November to 31st March and would then change to become chargeable from 1st April to 30th October each year at the same rate as the remaining spaces in Lay-By 5, 1 unit per 2 hours or part thereof.  During the free period there would be a requirement for vehicles to use a parking disc (yellow time clock) to indicate their arrival time in the 3 hour bays and this would be indicated by signage installed there.

 

Lay-Bys 6 and 7 have space available to allow people wishing to park all day if they are unable to park in the remaining bays in Lay-By 5.

 

 

Recommendations

 

The Minister is recommended to approve the 12 x 3 hour maximum stay spaces in Victoria Avenue Lay-By 5 becoming permanent at the end of the trial period.
