Delegated Authority Decisions.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Delegated Authority Decisions for Noting by Minister

Decision(s): 

The Minister noted the decisions taken by officers under delegated powers in the period from 3 December 2007 to 10 January 2008. 

5 Beachside, La Rue du Pont, Grouville - 3 Year lease renewal between the Public of the Island and William Bertram Payn to commence 1 February 2008 until 31 January 2011.  Existing rental is £19,166 per annum and the new rental will be £20,000 per annum subject to an annual rent review in accordance with Jersey Retail Price Index. 

6 Beachside, La Rue du Pont, Grouville - 3 Year lease renewal between the Public and William Bertram Payn to commence on 9 December 2007 until 8 December 2010.  Existing rental £19,166 and new rental will be £20,000 subject to an annual rent review in accordance with Jersey Retail Price Index. 

13 Maison d’Azette, St Clement - Sale of Unexpired Portion of Lease from Mr Richard John Brooks and Mr Peter Christopher Brooks to Mr Steven Robin Megaw. 

Albert Pier Terminal, Office A30A  - Re-letting to Blue Water Supplies Limited 

H7 Quennevais Park – Sale of Unexpired Portion of Lease from Mr Stanley Anthony Aked and Mrs Gladys Joyce Aked née Gavey to Miss Angela Aked. 

Les Bourgeons Farm – 5 year lease renewal between the Public and Mr Peter John Le Feuvre to commence on 1 January 2007 at a commencing rental of £7,863.84 per annum subject to annual reviews in accordance with Jersey Retail Price Index. Terms and conditions have also been agreed with Mr Ernest Pitts for Fields 661 and 661A, Mrs Beryl Syvret for Fields 662 and 655, Mrs Lillian Michel for Fields 663 and 664, Mr Robin Coutanche for Field 738 and Mr Andrew Le Feuvre for Field 653 which formed part of the original agreement for Les Bourgeons Farm.

A2 Quennevais Park - Sale of Unexpired Portion of Lease from Malcolm Roland Noel and Mrs Marjorie Noel née Hughes to Mr David Malcolm Noel and Mrs Linda Samantha Hodge née Noel. 

New Ways Childrens Home, New St James Place, St Helier – Granting of rights to Langtry House Limited, in respect of certain encroachments towards New Ways Childrens Home.

Reason(s) for Decision: 

To note the officer decisions in respect of the lease renewals, sale of unexpired portion of lease and re-letting as detailed above made under delegated powers in accordance with the Minister’s Decision of the 20 February 2006. 

Resource Implications:   

There are no resource implications other than those set out in the decisions.

Action required: 

The Director of Property Holdings will advise the relevant departments of the Minister’s decisions.
