A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Conclusion

The proposal is to install equipment on the new tower recently erected. Cable and Wireless have equipment temporarily installed on another tower at this site, however this application is for the permanent site.

 

The application is a mast sharing opportunity at one of the existing 5 major communication sites on the Island.

Site Description

The site is the centre of operations for the Communication Services of the States. The site consists of the Communication Services building and three large lattice towers or masts, which hold communications equipment for the States, including the Airport and emergency services, television and radio transmitters and mobile phone antennae.

 

 

Relevant Planning History

S/2005/2244 Approval granted in May 2006 for the installation of 6no. antennae, 6no. dishes and 4no. equipment cabinets for Cable and Wireless. This permission lapsed in May 2007 as the new tower had been constructed in the timeframe anticipated.

 

S/2006/1195 Approval granted in July 2006 for 3no. antennae for Jersey Telecom.

 

S/2006/1553 Approval granted in August 2006 for the temporary installation 3no. antennae, 2no. dishes and 1no. equipment cabinet for Cable and Wireless.

 

S/2006/2115 Approval granted in January 2007 for the temporary installation of 5no. dishes, 3no. antennae and 3no. equipment cabinets for Jersey Airtel.

H&SS in their letter dated 22 October 2007 confirm that the pre-commissioning details are below the international guidelines, being the ICNIRP Radio Frequency Public Exposure Guidelines. A post-commissioning test is required to ensure the actual emissions are in line with the estimated. Condition recommended to this effect.

Planning Issues

Policy Considerations (What are the presumptions)

In accordance with NR12, telecommunications development will normally be permitted where:

(i) siting and design will not unreasonably affect the character and amenity of the area;

(ii) all practicable possibilities of sharing facilities have been fully explored and found to be unfeasible or unacceptable by the Minister;

(iii) there would be no unacceptable impact on residential amenity;

(iv) the proposal is in accordance with other principles and policies of the Plan.

 

Siting and Design

The application is to install equipment on the newly erected tower at La Chasse. The visual impact of the tower has already been considered in the previous application for the tower itself. The siting of the antennae, being on an existing lattice tower, will not materially impact on the appearance of the tower and thus the antennae will not unreasonably affect the character of the area.

 

The siting of the ground base cabinet will be close to the existing building, thus reducing its visual impact to the wider area.

 

Site Sharing

The necessity of this site is to gain coverage to the areas of La Ville Bagot and Le Petite Cueillette areas and to provide a transmission link to other sites.

 

This application is for mast sharing at one of the existing 5 major communication sites on the area.

 

Residential Amenity

There will be limited impact to residential amenity from this application, as the main impact is from the tower itself, which has already been assessed and determined.

 

Other Policies of the Plan

The proposal is in accordance with the other policies of the Island Plan.

Conditions/

Reasons

1.         The development hereby permitted is temporary and shall cease on or before 12 months from the date of this permit and the land restored to its former condition unless the post commissioning test is completed and the relevant measurements are in accordance with the ICNIRP certificate submitted, to the satisfaction of the Minister for Planning and Environment.

 

2.         The permission hereby granted is for a temporary period of 12 months in the first instance. In the event that the Minister for Health and Social Services, during that 12 month period, should change his policy on the safety of telecommunication installations to the effect that they constitute a danger to the public nearby, the Minister for Planning and Environment will review the permission and may require the installation to be removed within a period of 3 months of the Minister for Health and Social Service’s change of policy. Should the Minister for Health and Social Service’s policy not change within 12 months, this permission will have permanent effect.

 

3.         The development hereby permitted is temporary and shall cease on or before 12 months from the date of this permit and the land restored to its former condition unless a programme of ongoing monitoring of the installation is submitted to and approved in writing by the Minister for Planning and Environment.  The scheme shall include monitoring in accordance with the ICNIRP certificate provided, appropriate independent testing at 12 monthly intervals for the duration of the operation of the installation, and shall be funded by the operator.
