Community Relations Trust: Re-appointment of Chairman

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Constitution of the Jersey Community Relations Trust, as amended by the States on 20 January 2004, sets out the aim of the Trust as follows –

 (f) To promote recognition and acceptance of cultural diversity.

(g) To promote training in furtherance of the aim of the Trust and the development thereof.

(h) To provide information and advice and facilitate initiatives concerning discrimination.

 (i) To sponsor and support research in furtherance of the aim of the Trust.

 (j) To take measures to counter discriminatory behaviour, attitudes, and policies.

 (k) To monitor these objectives.

Appointment of Chairman

Paragraph 5.1 of the Trust Constitution requires the Minister for Home Affairs to give at least 15 days’ notice to the States of his intention to appoint a Chairman, who is not a member of the States, to the Community Relations Trust.  This is in line with the States’ decision to change the procedure for most States-made appointments (P.205/2009).

Dr Elena Moran has been the Chairman of the Trust since 22 October 2008 when the States approved her appointment to the role for a 3 year period.  That tenure is due to expire on 21 October 2011.  The Minister is happy that Dr Moran is committed to the objectives of the Trust, and wishes to reappoint her for a further 4 year period in line with the Trust’s Constitution.

The experience and qualifications of Dr Moran with regard to this appointment are as follows –

Dr Moran holds a PhD in discrimination law.
