Prisoners Temporary Release Scheme: Replaced by Prisoners Conditional Early Release Scheme as of 4 July 2016

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Reason(s) for Decision:

To bring temporary release procedures in Jersey into greater alignment with practices across Europe.

 

Resource Implications: Additional supervisory role for the Honorary Police checking those on Home Detention Curfew, as agreed with the Comité des Chefs and Comité des Connétables.

Action required:

The Prison Governor to inform prisoners and other interested parties (Probation and Police) of changes to the early release policy.

Decision Summary

Background

The purpose of the Conditional Early Release Scheme is to bring practise[TW1][BM2] in Jersey more into alignment with other jurisdictions, while ensuring that individuals are monitored in the community on conditional licence to ensure public safety.

Prisoners in the UK and elsewhere in Europe are considered for release into the community at an earlier stage of a custodial sentence.  Prisoners may become eligible for consideration for conditional release on Home Detention Curfew (HDC) at 50% of the custodial sentence or a maximum of 18 months from the prisoner’s final release date.  Any applications for conditional release will continue to be considered by the Release on Temporary Licence Panel, which is chaired by the Prison Governor and includes an independent member.

Prisoners on HDC will have to be in employment; if not in paid work, then on community work.  It should be noted that those prisoners who are unable to provide a suitable address for HDC will no longer be able to access community visits, community work or home leave. 

The prison Outworker’s Unit, which has a very limited remaining lifespan in any case, will be closed.

 

Supervision: The Jersey Probation and Aftercare Service will provide supervision to those on early release and the Honorary Police will continue to carryout checks on individuals during curfew times.

 

Prison Service personnel will also make frequent but random checks on individuals during normal daytime activities.

[BM2]Don’t think so. I am referring to continuous release of prissoners into the community at the 50% stage rather than ‘the scheme or practice’.
