Building Bye-laws (Jersey): Proposed amendments

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Proposed amendments to the Part 6 requirements of the Building bye-laws (Jersey) 2007 and the Technical Guidance published in support of those requirements.

 

1.     Purpose of the Report.

 To seek the Minister’s formal approval for revised technical guidance to be  published in support of the drainage, sanitation, hot water safety and water               efficiency requirements of the building bye-laws. (2014 Edition of the Part 6               Technical Guidance Document attached).

 

  1. Background.

 In September 2013, the Minister approved the release of a draft technical guidance               document entitled, drainage, hygiene and hot water storage for public               comment. (MD-PE-2013-0108). That document was published on the gov.je               website on 7 October 2013. Comments on the proposals were invited to be               submitted on or before 25 November 2013.

 

  1. Main changes in the revised Document.

The Technical Guidance Document - Part 6, has been updated to reflect changes to British Standards and to provide guidance on meeting new bye-law requirements aimed at improving water efficiency in newly constructed homes. The opportunity has also been taken to combine the technical guidance currently published in support of the Part requirements into a single document. An outline of the main changes can be found on the inside of the front cover to the Technical Guidance Document. 

 

  1. Discussion on comments received.

 A summary of the findings of the consultation process is set out in Appendix 1.   Only four completed questionnaires were received therefore this cannot be               regarded as statistically meaningful, or an accurate account of public opinion. The               completed questionnaires do however show general support for the proposed               changes. Each of the points raised has been addressed by officer comments and               none are considered sufficient to warrant any significant changes to the draft               guidance.

 

  1. Legal and Resource Implications

 The Minister is empowered under Article 32 of the Planning and Building (Jersey)               Law 2002, to publish Technical Guidance for the purposes of providing guidance on               any requirement of the Building Bye-laws. There are no Departmental resource               implications arising from the publication of the document. 

 

  1. Recommendation

 That the Minister:

 

  1. Endorses the response to the comments received, and authorises officers to publish this as a formal response to the consultation; and

 

  1. Publishes the revised Technical Guidance Document Part 6, to take effect from 01/07/14, for the purposes of providing guidance on meeting the requirements in Part 6 of the second schedule to the building bye-laws (Jersey) 2007, as amended.
