A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

At a public meeting held on the 23rd November 2007 the Minister decided to maintain refusal of Planning Permission. However he did indicate that a properly constructed enclosure of either timber or granite might be more favourably considered.  Also that the applicant should give consideration to the future position of the oil tank and indicate it on the new application drawings.

Comments on Case

The main farm house and surrounding farm buildings are Registered as Buildings of Local Interest (BLI) dating from 1683. They form a pleasing group around a central yard. Any alterations must conform to Policy G13.

The proposal, for an oil fired boiler measuring 1005 x 650mm and 1100mm in height with a painted metal casing, would be sited on the east facing wall of the cottage attached to the main farmhouse and in the main farmyard. Although not visible from the road the siting is prominent within the group of residential and barn buildings.

Receipt of the original application, and of this Request for Reconsideration were advertised in the press and on site. No representations have been received.

The Historic Buildings Advisor objects to the proposal as this would place an alien intrusion on the wall of this simple and well proportioned building, it would therefore harm the BLI, the impact on the appearance being considerable. She adds, a break through the wall would also be necessary for the connection, so there would be no gain over an internal boiler requiring an aperture for a flue, although two vents in this wall already exist. A copy of this consultation response, dated 22/05/07, is attached.

An internal boiler or alternative siting within the adjoining garage are possibilities.

The agent maintains that the boiler would only be visible to the owner and tenants, who require the boiler to heat the house which is currently heater by an open fire and back boiler. This letter, dated 10/09/07, is attached.
