Road Traffic (St. Helier) (Jersey) Order 1996: Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENT TO ROAD TRAFFIC (ST HELIER) (JERSEY) ORDER 1996

 

 

Purpose of the Report

 

To introduce the ability to issue a permit for electric vehicles which are used in an electric vehicle car share club initiative. The new permit will then enable the vehicle to which these are issued to park in dedicated spaces on street between each client use.

 

 

Discussion

 

A request has been received from the Parish of St Helier in relation to the trial of an electric vehicle car share initiative. The October St Helier Road Committee meeting agreed to provide 4 No spaces on Parish administered roads for the parking of the electric vehicles concerned. 2 spaces in the Parade (Eastern Arm – echelon parking adjacent the doctors spaces) and 2 spaces in Halkett Place (North – adjacent the Mechanics Institute) have been identified for this purpose.

 

To enable this trial to take place, each qualifying electric vehicle will be issued with a new type of permit and the 4 spaces identified will be set aside for parking only electric vehicles that are issued with the new permit and have this displayed on the vehicle. There will be no time restrictions on these spaces.

 

An Amendment to the Road Traffic (St Helier) (Jersey) Order 1996 will be required to enable the creation and issuance of the new type of permits and the creation of the new parking areas.

 

Administration of and issuance of the new permits will be the responsibility of the Parish of St Helier for Parish roads and the Minister of Infrastructure for GHE roads.

 

The trial of this new scheme is in line with the Sustainable Transport Policy principles and also supports the Government commitment to become carbon neutral by 2030.

 

 

Recommendations

 

The Minister is recommended to support this request and to instruct for the Amendment to the Road Traffic (St Helier) (Jersey) Order 1996 to be prepared for subsequent signing.
