A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

1. The granite roadside wall and the railings shall be reinstated exactly (in the position shown on approved drawing "C") in terms of their appearance (including pointing) as the granite wall and railings that have been removed from the site.

2. Notwithstanding the information submitted and approved as part of this application, granite pillars to match those at the property immediately to the northwest shall be constructed to the satisfaction of the Historic Buildings Officer.

Reasons

1. The appearance of the granite wall and the railings has been specified to ensure that their reinstatement maintains the character and appearance of this registered building and the streetscape in accordance with Policy G13 and BE2 of the Jersey Island Plan, 2002.

2. To maintain the character of the Registered Building and the streetscape in accordance with Policy G13 and Policy BE2 of the Jersey Island Plan, 2002.

Policy BE2 – Proposals in The Town of St Helier

In considering development proposals in the town of St Helier, the

Planning and Environment Committee will take the following matters into account as appropriate:

(i) the context of the development and its contribution to built form, townscape, public realm and amenity open spaces;

(ii) the protection of local historic character by limiting adverse impacts upon historic and cultural resources;

Policy G13 – Buildings and Places of Architectural and Historic Interest

There will be a presumption in favour of the preservation of the architectural and historic character and integrity of registered buildings and places. Applications for the alteration or change of use of a registered building must contain sufficient information against which the impact on the fabric and appearance of the building can be assessed.

Permission will not normally be granted for the:

(i) total or partial demolition of a registered building;

(ii) extension or other external alteration works which would adversely affect the architectural or historic interest, character or setting of a registered building or place;

 

Recommendation

Maintain condition and sanction the serving of an Enforcement Notice for the work to be carried out, if the pillars are not constructed within 3 months of the decision date.

 

Comments on Case

In reply to the 3 points in the letter of the 26th October 2005 the comments are put forward:

  1. The road is one-way (from the northwest) and the pillar would only reduce extremely marginally the visibility from the access due to the existence of a high boundary granite wall that already restricts visibility.
  1. Correct, but neither does the “unfinished” railings as currently exist.

The installation of pillars would however match the appearance of those properties in the road that either a longstanding, or sympathetically formed, opening in the roadside wall. The properties on the northeast of Parade Road have a formal facades and roadside frontages. Whilst some of these frontages have been lost it is The Minister for Planning and Environment’s role to ensure that new development maintains the character of streetscapes, and Registered Buildings as set in policies G13 and BE2.

Presently, the roadside opening looks weak and informal, as if an opening has been cut through the wall and railings rather than as a considered feature of the property and the streetscape.

  1. As stated in item 2, it is not specifically the age of the pillars that is important but the material from which they externally finished and there form which is important to the property and the streetscape. Notwithstanding this, the Planning Officer has been advised by the owner of the neighbouring property that the pillars are indeed original features.

The pillar to the northwest is an adequate example of a suitable pillar to copy.

 

 

Recommendation

Maintain condition and sanction the serving of an Enforcement Notice for the work to be carried out, if the pillars are not constructed within 3 months of the decision date.
