Road Traffic (St. John) (Amendment No. 7) (Jersey) Order 2013

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST JOHN) (JERSEY) ORDER 1982

 

 

Purpose of the Report

 

To amend the Road Traffic (St John) (Jersey) Order 1982 to formalise the trial of a new parking area and to introduce new prohibition of waiting restrictions on Route du Nord, La Route du Mont Mado and La Ville Des Chenes.

 

 

Background

 

Further to MD-T-2013–0090 the Parish of St John has requested the Minister for TTS to include in the amendment to the Road Traffic (St. John) (Jersey) Order some restrictions the Parish has trialled. These trials comprise prohibition of waiting in La Villes Des Chenes at the roundabout and at the north east of the village and on Rue de Carriere. The proposed amendment to the Road Traffic (St John) (Jersey) Order 1982 will include the restrictions below.

 

Temporary amendments under Article 68 of the Road Traffic (Jersey) Law 1956

 

A temporary amendment to the Road Traffic (St John) (Jersey) Order 1982 was made using powers granted under Article 68 of the Road Traffic Law. TTS officers and Parish officials are now satisfied that the temporary amendment is appropriate and therefore wish the change to be included in the Parish Traffic Order.

 

Amendment to Schedule 2 “Prohibition of waiting” of the Road Traffic (St John) (Jersey) Order 1982

 

The St John Road Committee has requested the placing of “Prohibition of Waiting” lines in efforts to improve road safety in the following locations: -

 

La Route du Mont Mado, Route Du Nord, La Villes Des Chenes and La Ruette de Carriere.

 

 

Discussion

 

The temporary amendment is detailed below.

 

Route Du Nord: -

 

Waiting Restricted - Maximum 20 Minutes During Any One Stay “East edge (From its junction with La Rue du Temple to its junction to La Rue de L’Eglise)”

 

Amendments to Schedule 2 “Prohibition of waiting” summarised below

 

La Villes Des Chenes:

 

  • West side from the northern junction with the roundabout to a point 40m further north.
  • From a point 40m from the junction with La Route des Issues to a point 20m further west.

 

These restrictions are intended to improve the safety of the estate for pedestrians and motorists alike.

 

La Ruette de Carriere:-

 

  • The entire length of the road from its junction with la Rue de la Porte to its junction with La Route du Mont Mado.

 

Route Du Nord:-

 

  • East side – from a point 10 yards south of La Rue du Temple to a point 10 yards North of La Route de St Jean.

 

The new restriction is required to prevent motorists parking to the south of La Rue de L’Eglise. Parking in this location has been observed since the 20min waiting time limit was introduced at the truck stop. It is considered to be dangerous as cars park on the blind bend before the junction with La Grande Route de St Jean.

 

La Route du Mont Mado

 

  • East Side from a point 10 yards north of La Rue des Issues to a point 100 yards further North.

 

The new restriction is required on La Route du Mont Mado to improve safety for residents leaving the estates on the west side of the main road.  The Committee believe it would be beneficial to restrict road side parking to the same side as the exits.

 

 

Recommendation

 

The Minister is recommended to approve the attached amendment to the Road Traffic (St John) (Jersey) Order 1982, to come into force 14 days after it is made.

 

 

Reason (s) for Decision

 

To amend the Road Traffic (St John) (Jersey) Order 1982 to make permanent the temporary amendment made under Article 68 of the Road Traffic Law and to introduce prohibition of waiting and to correct some articles where errors have been noticed
