Education, Sport and Culture 2007 Budget Transfers.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): 

The Minister approved the following budget transfers:

  • £500,000 from Education, Sport and Culture’s (ESC) revenue budget to their capital budget for the ICT Strategy phase II;
  • £60,000 from the Fee Paying Sports Facility capital vote to the ICT Strategy phase II;
  • £450,000 from the Hautlieu capital vote to the ICT Strategy phase II;
  • £298,000 from the Waterfront Enterprise Board share provision capital budget to ESC’s revenue budget in respect of the operating deficit of the waterfront pool in 2007; and
  • £250,000 from an amount held in the Contingency Fund to ESC’s revenue budget for the overspend on student grants in 2007.

Reason(s) for Decision: 

Financial Direction 3.6 requires certain budget transfers to be approved by the Minister for Treasury and Resources.

Education, Sport and Culture 2007 Budget Transfers  

  1. Purpose of Report
    1. The Minister is asked to agree the 2007 year end budget transfers for the Education, Sport and Culture Department (ESC) in respect of ICT funding, the waterfront pool deficit and the overspend on student grants.

  3. ICT Funding

The Minister will recall that in previous years it was agreed that ESC could use other revenue and capital balances to fund items from phase II of the ICT strategy, including enhancement of the existing network, replacement of items bought during phase I that were reaching obsolescence and developing new uses for the technology.

Future funding has now been identified within the States central IT vote, however, 2007 funding is still required.

2007 revenue funding has been identified from the following areas:

It is also requested that a further £510,000 be transferred from the following capital funds for ICT phase II:

2.2 Waterfront Pool

The latest accounts from Serco (Jersey) Ltd indicate a deficit of £298,000 in respect of the operation of the Waterfront Pool in 2007.

The administration of the pool was transferred to ESC in 2005 and at that time a commitment was made by the Finance and Economics Committee deficits would be funded centrally and that there would be no adverse affects on the ESC budget.  This funding is held in a WEB Leisure Pool capital vote and ESC are requesting £298,000 be transferred to cover the deficit.

2007 grants to students at university are overspent by £250,817, which is slightly lower than expected. 

ESC is requesting a transfer from the Contingency Vote of £250,000 to their revenue budget from the amount that is ring fenced in the vote for this purpose. 

  1. Recommendation

3.1 It is recommended that the Minister approve the following budget transfers:

  • £500,000 from ESC’s revenue budget to their capital budget for the ICT Strategy phase II;
  • £60,000 from the Fee Paying Sports Facility capital vote to the ICT Strategy phase II;
  • £450,000 from the Hautlieu capital vote to the ICT Strategy phase II;
  • £298,000 from the WEB Leisure Pool capital vote to ESC’s revenue budget in respect of the operating deficit of the waterfront pool in 2007; and
  • £250,000 from an amount held in the Contingency Fund to ESC’s revenue budget for the overspend on student grants in 2007.
