Road Racing (Karts) (Jersey) Order 2011

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Road Racing (Karts) (Jersey) Order 2011 as prepared on behalf of Transport and Technical Services, as the administering authority of the Motor Vehicle Races (Jersey) Law 1946.

Reason(s) for Decision: Further to MD-T-2011-0007, enabling preparation of the Order, the Minister accepted that the proposed road closures and associated traffic management were both reasonable and justified.

TRANSPORT AND TECHNICAL SERVICES

 

THE JERSEY KART AND MOTOR CLUB’S APPLICATION TO HOLD  KART

 

RACING AT SOREL POINT  IN 2011

 

 

 

Purpose of the Report

 

To accompany the signature copy of the Road Racing (Karts) (Jersey) Order 2011 enabling the closure of the Sorel Point Loop Road (St John) and the holding of kart racing events (including practices) during 2011.

 

 

Background

 

The Jersey Kart & Motor Club (the Promoter) has submitted details of its proposed kart racing schedule for 2011. The races are enabled by Order of the Minister for Transport and Technical Services under Article 2 of the Motor Vehicle Races (Jersey) Law 1946.

 

The Promoter has gained the support of the Parish of St John for the races. They have also supplied proof of Public Liability Insurance.

 

 

Discussion

 

The Club is proposing to hold thirteen single day & three two day racing events this year, between 05 March and 30 October (see attached schedule); this is the same number of confirmed races as last year (nineteen in total). The Club has also requested an ‘alternative’ race date to be used in the event that the championship season overruns due to bad weather cancellations. This means that the last possible race date is Sunday 06 November.

 

 

Recommendation

 

The Minister is recommended to sign the Road Racing (Karts) (Jersey) Order 2011 as prepared.

 

 

Reason(s) for Decision

 

Further to MD-T-2011-0007, enabling preparation of the Order and following statutory consultations, the proposed road closures and associated traffic management are reasonable and justified.
