Scrutiny review Design of Homes S.R. 15/2007- Minister's approval

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

           The Environment Scrutiny Panel’s report S.R. 15/2007 –‘Design of Homes Review’.

 

Decision(s):

The Minister decided to:

  1. approve the report entitled ‘Reply of the Minister for Planning and Environment’;
  2. agree the Action Plan for the design of new homes.

 

Reason(s) for Decision:

  1. to outline the Minister’s position in respect to the findings and recommendations of the Environment Scrutiny Panel;
  2. to set out where action is required in relation to the Panel’s findings and recommendations on the design of homes;
  3. to help ensure that new housing developments are well-planned and well-designed and that the Panel’s report and the Minister’s response are used to inform:
  4. the current Island Plan review process; and
  5. the emerging Supplementary Planning Guidance on ‘The Design of New Homes’.

       4.  to comply with the guidance for Minister’s responding to scrutiny reports.

 

Resource Implications:

It is anticipated that the work arising will be carried out using existing resources.

 

Action required:

  1. Send copies of the Minister’s reply report to:
  2. The Chairman of the Environment Scrutiny Panel
  3. The Council of Ministers (for information)

 

 

  1. Send copies of the Minister’s reply report and his Action Plan to Deputy Sean Power, the Island Plan Team and other relevant officers (to address commitments).

 

  1. Pass a copy of the Minister’s reply report to the States Greffe so that it can be presented to the States for information.

 

  1. Publish the Minister’s reply report on the department’s gov.je website

 

  1. Prepare a media release
