A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

1. The proposed external works would harm the architectural, historic interest and integrity of this building and adjacent dwellings which are included on the Minister for Planning and Environment's Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a Proposed Site of Special Interest, contrary to the standards of Policy G13 (ii) and (iii) of the Jersey Island Plan, 2002.

Comments on Case

The agent establishes that the property is a Proposed Site of Special Interest and as “it is not yet a Site of Special Interest should therefore not be treated as one at the current time”. However, the Proposed Site of Special Interest as designated for the ‘keystone’ property of ‘Les Jardins’ ensures that the historic character and integrity of the original dwelling is not compromised and includes other associated buildings within the registration thereby protecting the site as a whole. Although, 3 Les Jardin, is a recent modern addition to the group which was approved as part of the overall development of the site in 1999 it does due to its close physical proximity and prominence to ‘Les Jardins’ form part of the historic designation of the site.

Although the adjacent properties to the west of the site show existing brick chimneys; small timber conservatories and entrances through the northern garden wall, it is likely that some of these features formed part of the original designs. However, as 3 Les Jardin, is a new addition to the group it was likely that it was constructed in a manner that ensured that it remained a more modest and thereby subservient addition to the registered group as a whole. This was to ensure its presence would not detract from or harm the historic character and integrity of the original existing dwellings which would have been constructed during the mid to late 19th century.

Consultation comments from the Design and Conservation Section view the proposals as damaging in terms of their context when assessed against the ‘keystone’ property which is, simple, elegant and uncluttered.

In conclusion the proposals may seem minor when considered individually but when considered collectively within the historic registration of the group the proposals raise obvious concerns in terms of the sites historic registration as a Proposed Site of Special Interest which would be damaging to the ‘Keystone’ property of ‘Les Jardins’, 3 Les Jardins, as well as the associated dwellings forming part of the registered group.

Therefore for the reasons highlighted above it is recommended that the decision to refuse this application be maintained.
