Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

A decision made (04.12.2008) to approve grants to the Road Safety Panel to fund publicity campaigns.

COMMUNITY SAFETY FUND – AWARD OF GRANTS

Purpose of the Report

To consider a recent application for grants from the Community Safety Fund.

Background

In June and December 2007, interim arrangements for considering applications for and awarding grants from the Community Safety Fund, for small but important initiatives, were approved by the Minister (MD-T-2007-0058 and MD-T-2007-0112).

The criteria approved by the Minister for considering applications and awarding grants in the interim are:-

· The proposal should be beneficial to the community at large;

· For one off items of expenditure directly related to community safety;

· Island based;

· For proposals that would significantly enhance or raise awareness on community safety and for which there is no or insufficient public funding;

· A maximum interim award of £10,000 per project.

Discussion

A further application has been received for grants from the Community Safety Fund, as outlined below.

Further to the States decision last February to promote legislation that would make it compulsory for adults to wear seat belts when travelling in the rear of cars and to update the legislation regarding restraints to be worn by children travelling in cars, it will be necessary to publicise these changes when the changes in legislation are introduced. The Road Safety Panel will direct this publicity but is seeking help with funds to cover the expenses involved. Further details of the proposal are outlined in the letter from the Road Safety Panel, dated 18 November 2008, a copy of which will be available to the Minister when considering his decision. The campaigns will not run at the same time. It is expected that the necessary changes to legislation to introduce the compulsory wearing of seat belts by all in the rear of vehicles will happen shortly whereas the changes to legislation governing child restraints is some months away.

The application meets the criteria and sufficient funds remain available in the Community Safety Fund.

Recommendation

The Minister is recommended to award grants of £8,106 and £8,150 to the Road Safety Panel to fund two publicity campaigns; one covering compulsory wearing of rear seat belts by adults and one advertising changes to child seat belt legislation.
