Gorey Fete (Jersey) Order 2010

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Gorey Fete (Jersey) Order 2010 as prepared on behalf of Transport and Technical Services, as the administering authority of the Entertainments on Public Roads (Jersey) Law 1985.

Reason(s) for Decision: Further to MD-T-2010-0037, enabling preparation of the Order and following statutory consultations, the Minister accepted that the proposed road closures and associated traffic management were both reasonable and justified.

TRANSPORT AND TECHNICAL SERVICES  

ST MARTINS GYMKHANA AND FETE COMMITTEE’S  APPLICATION TO HOLD  

THE GOREY FETE 2010  
 

Purpose of the Report  

To accompany the signature copy of the Gorey Fête (Jersey) Order 2010 enabling road closures and traffic restrictions for the purpose of holding the Gorey Fête on Thursday 19 August 2010.   
 

Background  

The St Martin’s Gymkhana and Fête Committee (the Promoter) has submitted details of its proposed road closures and traffic restrictions for the 2010 event. The event is enabled by Order of the Minister for Transport and Technical Services under Article 2 of the Entertainments on Public Roads (Jersey) Law 1985.  

As per the requirements of the Law, a draft Order has been prepared and circulated to the Connétables of Grouville and St Martin, as well as the Harbour Master (Jersey Harbours) for consultation, who have endorsed the event and its Order. The Promoter has supplied proof of public liability insurance. 
 

Discussion  

The Order will enable the event promoter to close Gorey Pier and adjacent coach parking area for the purpose of the event, as well as to restrict traffic in the vicinity. 

Restrictions for this year’s event will be similar to those of 2009 in that the Order provides for a one-way system on Gorey Coast Road, Le Mont de Gouray, Beach Road, La Route de la Côte and La Route Le Brun. These restrictions will apply from 8.00 a.m. on the day of the Fête until 10.00 a.m. the day after and are intended to reduce traffic problems, as well as aid the removal of vehicles parked on Gorey Coast Road. 

The St Martin’s Gymkhana and Fête Committee have once again asked for the inclusion of the provision first introduced in the 2006 Order giving police officers and members of the Fête Committee discretionary power to restrict traffic to the site of the event (the Harbour Pier) in the interests of safety, where access to premises might ordinarily be granted. 

Other details are as per the 2009 Order.  
 

Recommendation  

The Minister is recommended to approve the Gorey Fête (Jersey) Order 2010 as prepared.
