Appointment of Technical Adviser for the Solid Waste Strategy Projects.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the appointment of Fichtner as Lead Consultant/Project Manager and Technical Adviser for the Solid Waste Strategy Project

Reason(s) for Decision:

Technical Adviser: Following a competitive tender, Babtie Fichtner were appointed as Technical Consultant for Solid Waste Strategy capital projects on 3rd October 2005 under the terms of a short form of the Association of Consulting Engineers Short Form of Contract. A more detailed form of contract has now been prepared with the Projects Legal Adviser and Ministerial approval for the appointment is requested. The revised appointment reflects the changes that have taken place with the Babtie Fichtner consortium.

Resource Implications:

The costs for the above advisory functions are included within the current Solid Waste Strategy budgets Q000C2657 and within the budgets proposed within the Report and Proposition P72/2008 “Energy from Waste Facility Establishment and Acceptance of Tender” for expenditure required post States Approval.

TRANSPORT AND TECHNICAL SERVICES  

SOLID WASTE STRATEGY - APPOINTMENT OF TECHNICAL ADVISER

FOR THE ENERGY FROM WASTE, IN-VESSEL COMPOST AND RE-USE AND RECYCLING CENTRE PROJECTS  
 
 

Purpose of the Report  

This report seeks the Minister’s approval to confirm appointments for the Technical Adviser for the Energy from Waste, In-Vessel Compost and Re-use and Recycling Centre Projects. 
 

Background  

The States of Jersey approved the Solid Waste Strategy on 13th July 2005. Following approval of P72/2008 of the preferred solution for an Energy from Waste Project on 8th - 9th July 2008 detailed planning application and then construction of the Preferred Solution is now required. Appointment of a technical adviser is therefore require to assist the Department in the procurement and construction of the proposed facility. 
 

Discussion  

Technical Adviser   

Following a competitive tender, Babtie Fichtner were appointed as Technical Consultant for Solid Waste Strategy capital projects on 3rd October 2005 under the terms of a short form of the Association of Consulting Engineers Short Form of Contract. A more detailed form of contract, (based upon the Conditions of Engagement A(1) Civil/Structural Engineering Lead Consultant by the Association of Consulting Engineers (ACE) A(1) format as amended), has now been prepared with the Projects Legal Adviser. 

The original appointment was with Babtie Fichtner Limited - a joint venture company between Fichtner Consulting Engineers Limited and Jacobs UK Limited. A preference by the two Joint Venture companies to wind down the Babtie Fichtner Joint Venture, together with a reduced role for Jacobs UK Limited on the project going forwards, means that the proposed appointment is with Fichtner Consulting Engineers Limited. Jacobs UK Limited will still be a sub-contracting partner to the project.  

The estimated cost of the Technical Consultant and Project Management role under the Engineering Procurement and Construction Contract is estimated to be £1.8 Million with a further £150,000 for enabling works design and project management costs.  

The size of the contract sum means that Ministerial approval for the appointment is requested. The contract will require to be sealed.  

Recommendation  

The Minister is recommended to approve the appointment of the technical adviser to the Energy from Waste Project. 
 

Reason(s) for Decision  

The Report and Proposition P72/2008 “Energy from Waste Facility Establishment and Acceptance of Tender” was debated and approved in the States Assembly on 8th and 9th July 2008.  The above adviser appointments are required to progress the Energy from Waste facility in a timely fashion.

 
 

Action Required  

That the Minister agree to:
