Road Traffic (Speed Limits) (Amendment No. 9) (Jersey) Order 2015

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister made the Road Traffic (Speed Limits) (Amendment No 9) (Jersey) Order 2015.

 

Reason(s) for Decision: To lower speed limits on certain roads where the proposal has the support of the Connétable of the Parish and is consistent with current Policy.

 

Resource Implications: Installation of the required signage in the sum of £500 from the Department’s revenue budgets. Each Parish will be required to fund the signage where signs are erected on Parish by roads.

 

Action required: To notify the Publications Editor and the Law Draftsman that the Order has been made, forward the signed and sealed Order to the Publications Editor, States Greffe, and request the Greffier of the States to arrange for its notification to the States.

ROAD TRAFFIC (SPEED LIMITS) (AMENDMENT NO 9) (JERSEY) ORDER 2015

 

 

Purpose of the Report

 

To amend the Road Traffic (Speed Limits) (Jersey) Order 2003

 

 

Background

 

There are a number of outstanding requests to lower the speed limit on various roads on the island.  There is due to be an island wide speed limits policy consultation, however due to this being delayed the following speed limit amendments were deemed to be non-contentious and appropriate to be progressed without further delay. The following requests were approved by the previous Minister under MD-T-2014-0102.

 

 

Discussion

 

Following an assessment of requests to lower speed limits on certain sections of road it has been determined that it is appropriate to amend the Road Traffic (Speed Limits) (Jersey) Order 2003. The amendments will lower the speed limits on the following roads:

 

St Helier

The Parish Roads Committee has requested a 20mph limit on La Rue des Canons and also propose to install three speed humps.  The two measures are complimentary.  The road is a residential by-road and not appropriate for use as a through route.  A 20 mph limit is therefore considered appropriate.

 

St Saviour

The Connétable has requested that La Chasse Brunet and La Rue de Patier be designated a 20 mph limit.  Both are Parish by-roads with a high residential use, are used as walking routes to the various schools in the area, have few footpaths and are unsuitable as through routes.  A 20 mph speed limit would therefore be appropriate. 

 

St Brelade

Following the completion of significant housing developments on La Rue de la Sergenté, the eastern end of the road was designated a 30 mph limit in April 2014 with the limit returning to 40 mph at the western end of the built up area.  Although consistent with States policy to apply a 30 mph limit to the built up area, it has resulted in signage which could encourage motorists to increase their speed at the approach to the railway walk crossing.  It is therefore proposed to extend the 30 mph limit approximately 100m further west to a point immediately west of Le Coin / La Moye View so that the area of the railway walk crossing is covered within the 30 mph zone.  The Connétable is supportive of this alteration.  

 

 

Recommendation

 

The Minister is recommended to make the attached Order Amendment.
