New footpath on La Petite Route des Mielles, St. Brelade.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Proposal to cede Public land to the Parish of St Brelade so that the Parish can construct a new roadside footpath on La Petite Route des Mielles, in the area of the Railway Walk.

Decision(s): The Assistant Minister approved the commencement of negotiations between Jersey Property Holdings and the Parish of St Brelade for the transfer of ownership of approximately 74m² of land from the States of Jersey to the Parish of St Brelade, along the edge of La Petite Route des Mielles at its junction with the Railway Walk.

Reason(s) for Decision: To improve pedestrian facilities as well as cyclist and pedestrian safety at the junction of La Petite Route des Mielles and the Railway Walk.

Resource Implications: The work to be carried out by the States of Jersey within existing resource allocations.

Action required: Property Holdings to be instructed to seek the approval of the Minister for Treasury and Resources and commence appropriate negotiations with the Parish of St Brelade.  Transport and Technical Services Department to arrange to apply for Planning Approval in partnership with the Parish of St Brelade.

TRANSPORT AND TECHNICAL SERVICES  

PROPOSED NEW ROADSIDE FOOTPATH ON LA PETITE ROUTE DES MIELLES, ST BRELADE  
 

Purpose of the Report  

To instruct Property Holdings to negotiate the ceding of land alongside La Petite Route des Mielles to the Parish of St Brelade for the construction of a roadside footpath. 
 

Background  

The Connétable of St Brelade recently wrote to the Department proposing that a small area of land which currently comprises parkland at the junction of the Railway Walk and La Petite Route des Mielles be ceded to the Parish so that, subject to the appropriate Parish approvals, Ministerial approvals and Planning approvals, a roadside footpath be established at this location. 
 

Discussion  

The Parish of St Brelade have some concerns over the safety of pedestrians and cyclists at the junction of La Petite Route des Mielles and The Railway Walk.  The Parish Secretary and an officer of the Department met at this location to discuss the concerns. The Connétable of St Brelade has written to the Department proposing the following. 

  • That the Public of the Island cede to the Parish an area of land between the pavement which ends at the boundary between the Children’s Playpark and the Railway Walk to the boundary of the Railway Walk and the Property “Les Avenues”. The Parish, subject to approval of an Assembly of Electors of St Brelade, will be responsible for meeting the cost of creating the extended pavement.

 

  • The States of Jersey Transport and Technical Services Department to provide suitable fencing along the new edge of the Railway Walk so that cyclists are aware they should stop before entering La Petite Route des Mielles.

 

  • Signage warning cyclists and pedestrians they are approaching a public highway to be improved.

 

  • Should the proposals be agreed by the appropriate parties then the Public would prepare the appropriate contract for the transfer of the land.

 

It should be noted that the change of use from park land to roadside footpath will need to be the subject of a Planning Application and that the Treasury Minister’s approval will be required for the transfer of ownership of the land.

A drawing of the proposal and the land to which the proposal refers has been prepared and a copy has been provided at Appendix A. 
 

Conclusion 

The States of Jersey Strategic Plan states the intention to develop a sustainable internal transport infrastructure in order to persuade people out of cars, by providing practical alternatives such as improved bus services, cycle tracks and footpaths.  The Transport and Technical Services Department have been tasked with the responsibility of carrying this out.  The scheme proposed by the Parish at this location will improve the safety of cyclists and pedestrians in accordance with this Strategic Plan objective. 
 

Recommendation 

The Assistant Minister is recommended to approve the commencement of negotiations between Jersey Property Holdings and the Parish of St Brelade for the transfer of ownership of approximately 74m² of land from the States of Jersey to the Parish of St Brelade, along the edge of La Petite Route des Mielles at its junction with the Railway Walk.
