Field 759, La Rue du Boulivot, Grouville. Change of use of part of field to domestic curtilage. Request for Reconsideration of refusal of planning permission.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Change of use of part of field to domestic curtilage.  REQUEST FOR RECONSIDERATION of refusal of planning permission

Decision(s):

The above Request for Reconsideration was presented to the Ministerial Meeting of the 31st August, where the Minister deferred his decision to undertake a site visit. The site visit took place on 26th October 2007 and the Minister decided to approve the change of use for one part of the application site and up-hold the refusal for the balance of the site. 

The approved change of use to domestic curtilage relates solely to the triangle of land as shown edged red on Drawing B. The three sides of the triangle are formed by:

  1. the northern boundary of the applicants property;
  2. the western boundary of the property to the east, and
  3. the line formed by joining the north western corner of the applicants shed, with the north western corner of the curtilage of the property to the east.

 

Permission was not granted for a change in the use of the land outside the red triangle and the applicant was informed that it should not be ‘domesticated’ in any way, but that it may be possible to acquire the balance of the site with the consent of the Land Controls and Agricultural Development Section.

Reason(s) for Decision:

Permission has been granted having taken into account the relevant policies of the approved Island Plan, together with other relevant policies and all other material considerations, including the consultations and representations received.

It was considered that the grant of permission as a suitable exception to the Island Plan is justified in this instance having regard to all the circumstances of the case. 

Permission is subject to compliance with the following conditions / reasons: 

1. The change of use to domestic curtilage relates only to the land edged red on the  attached plan, referenced as Drawing B. The area outside the land edged red must not be  domesticated in any way.

Reason(s): For the avoidance of doubt, as permission is only granted to change the use of  this element of the site.
