Jersey Airport: Re-allocation of Capital Budgets for 2015

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister approved the reallocation of capital projects to correct the capital allocations for 2015 as detailed in the attached written report.

Reason(s) for Decision: 

Article 18(1) (c) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure. Delegation 1.2 delegates authority for non-contentious transfers between heads of expenditure of up to £1,000,000 to the Treasurer of the States.

Resource Implications: 

None. This decision is merely a reallocation between projects.

JERSEY AIRPORT transfers between Capital heads of expenditure

 

  1. Purpose of Report

 

To enable the Minister to approve a request from Ports of Jersey to transfer budgets between capital heads of expenditure in regards to the Jersey Airport 2015 capital allocation in the MTFP.

 

  1. Background

During April 2014 Treasury compiled the 2015 budget requests and allocated capital to different projects. Unfortunately a further Ports of Jersey submission made on 23 May was overlooked and instead the MTFP included allocations submitted as per a 20 May submission.

 

When this error was discovered the MTFP update had gone to publication. Treasury therefore requested Ports of Jersey to sign a Ministerial decision to correct these allocations.

 

  1. Revised capital allocations
    The following adjustments are required to correct the Jersey Airport 2015 capital allocations:

 

 

  1. Recommendation

 

The Minister is recommended to approve the reallocation of capital budgets to correct the capital allocations for 2015 and to request the Minister of Treasury and Resources to transfer the relevant budgets to effect the corrections.
