A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment determined that;

  1. A Notice of intent to vary the registration be served indicating that the BLI registration for La Palloterie be amended to just include No 2 (Vale View House) and No 5 (Vale View Cottage)

Reason(s) for Decision:

The registration of No 2 (Vale View House) and No 5 (Vale View Cottage) as BLI is in accordance with the published policy guidance as the buildings retain their historic form and detail, and so make a significant and positive contribution to the architectural and historical character and appearance of Jersey. The removal of other parts of the site from the Register is appropriate as they have been significantly remodelled and no longer retain their historic form and detail. (The surviving fragments of decorative stonework from an earlier building(s) are interesting as historical artefacts but they are all reused in later structures which do not meet the criteria for registration).

La Palloterie, Ivystill Lane, St. Saviour.

 

This report has been prepared by Jersey Heritage as part of its responsibility under a Service Level Agreement to provide reports and recommendations to the Minister for Planning and Environment on the architectural, historical and archaeological significance of buildings and sites.

 

The assessment and recommendation are made in accordance with the principles of selection for registration as set out in the interim policies for the conservation of historic buildings (1998). The report includes the views and advice offered by the Ministerial Registration and Listing Advisory Group.

 

The Planning and Environment Department requested on 11 April 2008 that Jersey Heritage assess the architectural, historical and other interests of La Palloterie.

Relevant interests of the site

 

Historic interest

 

19th century farm group incorporating decorative elements from an earlier building/s. Subdivided into 7 residential units 1982/3.

 

Architectural interest

 

The historic layout of the farmstead can be read and No.2 (Vale View House) and No.5 (Vale View Cottage) retain their external historic form and detailing. The other buildings were significantly remodelled in the 1980s. The architectural interest of each of the buildings is as follows:

 

No.1 - the 3-bay façade of the 19th century building has been retained with its original openings although there are new window and door fittings; the rear of the building and the roof have been amalgamated with a newly constructed property called The Old Barn. 

 

Re-built into a garden wall adjacent to The Old Barn is a round arch with keystone inscribed 1617 IH.

 

No.2 (Vale View House) - the former farm house, mid 19th century, 3-bay, 2-storey. Rendered walls with emphasised quoin bands. There are 4-pane sashes and barge-boarded dormers. The slate roof has rendered chimneystacks and ridge tiles. The house retains its external character.

 

No.3 (La Pallotterie) & No.4 - parts of the façade of a 19th century single-storey range with loft have been retained. This incorporates some decorative stonework from an earlier building that may have stood on the site (including chamfered window surrounds, an accoladed lintel and an inscribed lintel). The 1980s conversion significantly altered the range including rebuilding parts of the façade, removing the loft loading doors and openings, and reconstructing the roof with modern dormers. A new opening was also inserted at either end of the range and new window and door fittings added to existing openings. An adjoining single-storey range was demolished.  

 

No.5 (Vale View Cottage) - 19th century, 3-bay, 2-storey building of rubble granite with quoins, window and door openings with dressed brickwork. There is a slate roof with a pair of brick chimneystacks. 12-pane timber sash windows. Attached are single-storey outbuildings at the rear of the same construction. The building retains its original character.

 

No.6 (Vale End) & No.7 (The Meadows) - late 19th century barn that has been significantly altered including blocking of former carriage entrance and numerous new openings.

Advice offered by MRLAG (and others if stated)

 

MRLAG discussed the interest of the various buildings at its meeting on 6 May. Members requested further information on the 1980s conversion of the site and deferred detailed discussion until the next meeting. The discussion continued at MRLAG’s meeting on 9 June when members were provided with more details on the 1982/3 conversion works. The group considered the integrity and surviving historical and architectural interest of each of the buildings on the site.

 

Members unanimously agreed with the JH recommendation to retain No.2 (Vale View House) and No.5 (Vale View Cottage) on the Register as BLI as they substantially retain their external historic form and detailing; and to remove No.6 (Vale End) & No.7 (The Meadows) from the Register as they have been significantly remodelled.

 

However, members were not in agreement with the JH recommendation to restrict the BLI to No.2 & No.5, and argued that the surviving 19th century façades of No.1 and Nos.3-4 should be included for group value (in particular as decorative elements of an earlier building are incorporated in the latter). The group also argued that the early 17th century round arch should be included in the BLI for group value.

 

Jersey Heritage recommendation

 

The BLI registration for La Palloterie should be amended to just include No.2 (Vale View House) and No.5 (Vale View Cottage).

 

Justification relating to criteria

 

·        The registration of No.2 (Vale View House) and No.5 (Vale View Cottage) as BLI is in accordance with the published policy guidance as the buildings retain their historic form and detail, and so make a significant and positive contribution to the architectural and historical character and appearance of Jersey.

 

·        The removal of other parts of the site from the Register is appropriate as they have been significantly remodelled and no longer retain their historic form and detail. (The surviving fragments of decorative stonework from an earlier building/s are interesting as historical artefacts but they are all re-used in later structures which do not meet the criteria for registration).
